Resolution# 495-13 Adopted: April 9, 2013 TOWNSHIP OF WEST ORANGE ALCOHOLIC BEVERAGE CONTROL BOARD RESOLUTION WHEREAS, the Township Council of the Township of West Orange serves as the Township of West Orange Board of Alcoholic Beverage Control; and WHEREAS, an Application has been filed by Anthony DePersio on behalf of ARA Kitchen Group, LLC, 11 Alexander Avenue, Nutley, New Jersey 07110, for the renewal of its License #0722-33-037-006, for the period July 1, 2012 through June 30, 2013, and said License having been inactive and a Pocket License; and WHEREAS, the Licensee filed a Verified Petition with the Division of Alcoholic Beverage Control of the State of New Jersey requesting authorization for the local issuing authority to consider its Renewal Application for Plenary Retail Consumption License #0722-33- 037-006, for the 2012-2013, license term pursuant to the provisions of N.J.S.A. 33:1-12.39; and WHEREAS, the Division of Alcoholic Beverage Control of the State of New Jersey has authorized the Township Council of West Orange to consider the Application of ARA Kitchen Group, LLC, for renewal of its License for the 2012-2013, license term and to grant or deny said Application in the reasonable exercise of its discretion by Special Ruling dated March 4, 2013, accompanied by a transmittal letter of the same date setting forth any additional requirements to be met to activate the License; and WHEREAS, the Licensee has submitted its Application for Renewal to the Township Clerk and said Application complies with New Jersey State Laws regulating the sale, consumption, and distribution of alcoholic beverages, and any additional requirements imposed by the Special Ruling and its accompanying transmittal letter having been met, and renewal fees and taxes having been paid, and the Township Council in its capacity as the Township of West Orange Alcoholic Beverage Control Board, having held a public hearing on April 9, 2013, and no one appearing in opposition, wishes to renew this License; NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of West Orange, in its capacity as the Township s Alcoholic Beverage Control Board, hereby renews ABC License #0722-33-037-006, held by Licensee ARA Kitchen Group, LLC, c/o Anthony DePersio, 11 Alexander Avenue, Nutley, NJ 07110, for the 2012-2013 License Term. ____________________________________
