67-19 Authorizing Use of Competitive Contracting in Lieu of Public Bidding-Contract for Operation of Rock Spring Golf Co~.pdf

67-19 February 19, 2019 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) has approved execution of a contract for acquisition of the Rock Spring Golf Course (the “Golf Course”) which consists of approximately 137.92 acres located at 90 Rock Spring Road, also known as: Block 46.01, Lot 22; Block 160, Lot 2; Block 160, Lot 10; Block 160.01, Lot 30; Block 160.01, Lot 34 on the Township tax map (collectively the “Property”); and WHEREAS, the Township also seeks to investigate the possible retention of a vendor to manage, operate, and maintain the operations of the Golf Course; and WHEREAS, N.J.S.A. 40A:11-4.1(b)(1) of the Local Public Contracts Law (the “LPCL”) authorizes the Township to utilize competitive contracting in lieu of public bidding for the award of a contract for the “operation, management or administration of recreation or social service facilities or programs;” and WHEREAS, competitive contracting in lieu of public bidding allows the Township to evaluate and score proposals based on weighted criteria, including technical, management and cost related criteria to ensure that the most professional operator is obtained to meet the Township’s needs; and WHEREAS, competitive contracting is the preferred methodology to awarding a contract for the operation of the Golf Course based on the need to consider a prospective vendor’s experience and qualifications to perform the proposed contract; and WHEREAS, N.J.S.A. 40A:11-4.3 of the LPCL requires that the Township Council adopt a resolution authorizing the Township to utilize competitive contracting in order to initiate the competitive contracting process.
2 NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township be and hereby is authorized to utilize competitive contracting to solicit and review proposals for the potential contract to manage, operate, and maintain the Golf Course consistent with the requirements under the LPCL.
