117-13 June 11, 2013 RESOLUTION WHEREAS, on or about December 6, 2011, certain litigation captioned Sadlon, et al. v. The Pointe, et al., was commenced before the Superior Court of New Jersey, Law Division: Essex County, Docket No. ESX-L-9351-11 (the “Litigation”); and WHEREAS, the Litigation named the Township as a co-defendant based upon the November 25, 1997 Developer’s Agreement; and WHEREAS, the Court denied a temporary restraining order; and WHEREAS, the Court directed mediation; and WHEREAS, Plaintiff asserted certain claims against the Township; and WHEREAS, Barbara Weisman, Esq. was designated mediator; and WHEREAS, the mediator conducted various sessions and participated in various communications between the parties; and WHEREAS, pursuant to the mediation program, the mediation expenses are split evenly among the parties; and WHEREAS, the mediator expended a total of 8.8 hours in this matter; and WHEREAS, the mediator’s total invoice is $3,078.00; and WHEREAS, the Township’s portion of the invoice is $1,026; NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Township be and is hereby authorized to pay Barbara Weisman, Esq., as mediator, the sum of $1,026 in full satisfaction of all mediation expenses in this matter; and it is further RESOLVED that a copy of this Resolution shall be advertised and available in accordance with applicable law. ________________________________ Karen J.
