118-13 June 11, 2013 RESOLUTION WHEREAS, pursuant to the rules promulgated by the New Jersey Council on Affordable Housing (“COAH”) with respect to affordability assistance and affordable housing trust funds, specifically N.J.A.C. 5:97-8.1, et seq. and Township Code § 25-18.22, the Township has instituted a Development Fee Fund to fund, among other affordable housing programs, the Township of West Orange Emergency Repairs Program (“WOERP”), as referenced in and authorized by N.J.A.C. 5:97-8.8(a)(1) and Township Code § 25-18.22(h)(3)(a); and WHEREAS, the Daughters of Israel Geriatric Services, Inc. (the “Owner”) owns certain real property at Block 165, Lot 16 on the Township’s tax map, also known as the Jewish Federation Plaza at 748-750 Northfield Avenue (the “Property”); and WHEREAS, the Owner has requested monies from the WOERP, in an amount not to exceed $200,000, for emergency repairs to the Property in order to upgrade and correct any obsolete appliances and appurtances in need of replacement in the commercial kitchen at the Property; and WHEREAS, outdated and obsolete appliances in a commercial kitchen may pose a threat to the health and safety of the tenants; and WHEREAS, such grants from the WOERP are provided to preserve the affordability of the units for the tenants; and WHEREAS, Resolution 108-12 was adopted on May 29, 2012 and authorized the Owner to apply for and receive emergency repair monies from the WOERP; and WHEREAS, the Township’s Affordability Assistance Program Administrator has reviewed the Owner’s request for a grant from the WOERP and has recommended the award of same; and WHEREAS, the Owner has agreed to the terms set forth in an agreement annexed hereto as Attachment “A”;
NOW, THEREFORE, BE IT HEREBY RESOLVED, that the Mayor shall be and hereby is authorized to execute the document(s) necessary to effectuate such agreement with the Owner, and the Municipal Clerk shall be and hereby is authorized to attest to the Mayor’s signature; and be it further RESOLVED that this award shall be published and available in the Clerk’s Office for reasonable inspection in accordance with applicable law. ________________________________ Karen J.
