10-21 January 26, 2021 RESOLUTION A RESOLUTION ACCEPTING A GRANT FROM THE HAZARDOUS DISCHARGE SITE REMEDIATION FUND PUBLIC ENTITY PROGRAM THROUGH THE NEW JERSEY ECONOMIC DEVELOPMENT AUTHORITY AND THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION WHEREAS, on October 26, 2016, the Township of West Orange (the “Township”) adopted Resolution 228-16 designating certain properties on Central Avenue (the “Redevelopment Area”) as an area in need of redevelopment; and WHEREAS, the property at 8-10 Central Avenue, Block 9, Lot 32 on the Township Tax Map (the “Biddleman Property”) was included in the Redevelopment Area; and WHEREAS, on January 3, 2017, the Township passed Ordinance 2499-16 which adopted a Redevelopment Plan for the Redevelopment Area (the “Redevelopment Plan”), including the Biddleman Property; and WHEREAS, on October 2, 2018, the Township acquired title to the Biddleman Property WHEREAS, pursuant to resolution 252-18 the Township’s designated Licensed Site Remediation Professional (the “LSRP”) applied for grant funds from Hazardous Discharge Site Remediation Fund, Public Entity Grant Program (the “HDSRF Program”) through the New Jersey Department of Environmental Protection (the “DEP”) and the New Jersey Economic Development Authority (the “EDA”) for the purpose of funding the costs for preforming the Preliminary Assessment and Site Investigation along with report preparation for the Biddleman Property; and WHEREAS, the Township received a notice of award of $63,956 from the HDSRF Program to fund the Preliminary Assessment and Site Investigation on the Biddleman Property; and WHEREAS, the Township must execute a Grant Agreement, annexed hereto as Exhibit “A” to finalize the award of the grant from the HDSRF Program. NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE

4823-5394-8118, v. 1 TOWNSHIP OF WEST ORANGE, that the Township accepts the grant award of $63,956 from the HDSRF Program to fund the Preliminary Assessment and Site Investigation along with report preparation for the Biddleman Property; and be it further RESOLVED, that Mayor Robert D. Parisi is hereby authorized to execute the Grant Agreement and any and all grant documents as an authorize representative thereunder, as the representative for the Township; and be it further RESOLVED, that the Township Clerk is authorized to attest to the Mayor’s signature; and be it further RESOLVED, that a comprehensive plan in the form of the Redevelopment Plan exists specifically for the redevelopment of the Redevelopment Area, including the Biddleman Property, within a three-year period from the completion of the remediation of the Biddleman Property; and be it further RESOLVED that a certified copy of this Resolution shall be forwarded to the EDA and a copy of this resolution shall be made available in the Clerk's Office for reasonable inspection in accordance with applicable law.
