17-21 January 26, 2021 RESOLUTION WHEREAS, on Tuesday, June 9, 2015, the Township Council for the Township of West Orange (the “Township”) passed Resolution 156-15 which authorized the commencement of a declaratory judgment action with the Superior Court of New Jersey (the “Court”) consistent with the transitional process established in the New Jersey Supreme Court In the Matter of the Adoption of N.J.A.C. 5:96 and 5:97 by the New Jersey Council on Affordable Housing, 221 N.J. 1 (2015) to obtain a Judgment of Compliance and Repose for the Township’s adopted Housing Element and Fair Share Plan; and WHEREAS, on November 17, 2020, the West Orange Planning Board (the “Planning Board”) adopted a Housing Element and Fair Share Plan; and WHEREAS, on December 2, 2020, the Planning Board passed Resolution No. 20-08 memorializing its adoption of the Housing Element and Fair Share Plan, annexed hereto as Exhibit “A” pursuant to N.J.A.C. 5:96-2.2(a)(2). NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE hereby endorses the Housing Element and Fair Share Plan as adopted by the West Orange Township Planning Board; and it is further RESOLVED, pursuant to the provisions of N.J.S.A. 52:27D-301, et seq. and N.J.A.C. 5:96-3.4, authorizing the submission of this adopted Housing Element and Fair Share Plan to the Court for review and approval; and be it further RESOLVED, that a list of names and address for all owners of sites in the adopted and amended Fair Share Plan, including the names and address of any objectors, has been included; and be it further

4850-8914-7094, v. 1 RESOLVED, that notice of this adoption shall be published in a newspaper of countywide circulation pursuant to N.J.A.C 5:96-3.5 within seven (7) days of issuance of a notification letter from the Court indicating that the submission has been received and is under review and that a copy of this resolution, the adopted Housing Element and Fair Share Plan and all supporting documentation shall be made available for public inspection with the Office of the Township Clerk located at 66 Main Street, West Orange, New Jersey during the hours of 8:30 a.m. until 4:30 p.m. on Monday through Friday for a period of 45 days following the date of publication of the legal notice pursuant to N.J.A.C. 5:94-3.5 ; and be it further RESOLVED that a copy of this Resolution shall remain on file with the Township Clerk for inspection by the public.
