2626-21 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 19, THROUGH STREETS AND SUBSECTION 7-21.2, MULTI-WAY STOPS NEAR SCHOOLS, PLAYGROUNDS AND YOUTH RECREATIONALFACILITIES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey, that the intersection of Forest Avenue and Ellis Street be designated as a Multi-Way Stop pursuant to N.J.S.A. 39:4-8(d) under the Municipal Engineer's Certification and License Number GE026706 and that the limits of Forest Avenue being designated a Through Street be amended to reflect the Multi-Way Stop as follows: Section 1. The Township Council of The Township of West Orange finds it in the interest of public safety to designate the intersection of Forest Avenue and Ellis Street as a Multi-Way Stop pursuant to N.J.S.A. 39:4-8(d). Section 2. The Municipal Engineer of the Township of West Orange has submitted and certified all the legislative requirements pursuant to N.J.S.A. 39:4-8(d) and specifically that both Forest Avenue and Ellis Street are under municipal jurisdiction; that their intersection is within 500 feet of a school, or of a playground or youth recreational facility; and that the intersection is on a street contiguous to a school, or playground or youth recreational facility. Section 3. Subsection 7-21.2, Multi-Way Stops Near Schools, Playgrounds or Youth Recreational Facilities, of the Revised General Ordinances of the Township of West Orange is hereby amended and supplemented as follows pursuant to the provisions of N.J.S.A. 39:4-8(d) (italic type denotes deletion, bold type denotes addition): Intersection Stop Signs On Forest Avenue and Ellis Street All intersecting streets Section 4. Subsection 7-19, Through Streets, of the Revised General Ordinances of the Township of West Orange is hereby amended and supplemented as follows (italic type denotes deletion, bold type denotes addition): Name of Street Limits Forest Avenue Eagle Rock Avenue and Woodland Avenue Forest Avenue a. If any provisions of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any of the provisions or applications of this Ordinance that can be given effect without the valid provision(s) or application and to this end, the provisions of the Ordinance are severable. Section 6. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 7. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of any provision of this Ordinance or any supplement thereto shall be liable to the penalty of not more than fifty dollars ($50.00) or imprisonment for a term not to exceed fifteen (15) days or both. Municipal Clerk Introduced: January 5, 2021 Adopted : January 26, 2021 2626-21 LEGISLATIVE HISTORY This Ordinance, which amends the Traffic Regulations of the Township, designates the intersection of Forest Avenue and Ellis Street as a Multi- Way Stop with stop signs on all intersecting streets. This designation is made pursuant to N.J.S.A. 39:4-8(d) which allows municipalities to designate any intersection as a stop intersection, including multi-way stops, provided both streets are under municipal jurisdiction; that the intersection is located within 500 feet of a school, or of a playground or youth recreational facility; and that the intersection is on a street that is contiguous to a school, or playground or youth recreational facility. The Municipal Engineer certified that the intersection of Forest Avenue and Ellis Street meets all three criteria.
