#13-04 RESOLUTION OF THE PLANNING BOARD OF THE TOWNSHIP OF WEST ORANGE Heard: July 9, 2013 WHEREAS, pursuant to a Resolution of the Township Council of the Township of West Orange entitled “Resolution of the Township of West Orange, County of Essex, New Jersey Requesting the Planning Board to Review and Make Recommendations With Regard to Proposed Amendments to the Harvard Press Redevelopment Plan,” adopted June 25, 2013, the Planning Board of the Township of West Orange, at its July 9, 2013 regular meeting, discussed a proposed amendment to the Harvard Press Redevelopment Plan, dated April 7, 2008 and adopted by the Township Council on April 29, 2008 by Ordinance No. 2168-08; and WHEREAS, the proposed amendment modifies page 17 of that Plan, as follows: 1. Striking the following language: Permitted uses in the MUBR Zone shall be limited to multi-family residential uses and those uses allowed in the B-1 Zone. The residential units shall be condominium type units that are individually sold in the general real estate market place and not yented. This use provision may need to be amended upon completing the research of the remaining propertics located in Block 9 and along Central Avenue. Any use not expressly permitted in the MUBR Zone shall be prohibited, including rental units; and 2. Inserting the following language in its place: Permitted uses in the MUBR Zone shall be limited to multi-family residential uses and those uses allowed in the B-1 Zone. Any use not expressly permitted in the MUBR Zone shall be prohibited; and WHEREAS, the Planning Board gave the proposed amendment its due consideration and concluded that the proposed amendment was reasonable and consistent with the goal of redeveloping the property;

NOW, THEREFORE, BE IT RESOLVED by the Planning Board of the Township for West Orange that the Harvard Press Development Plan should be amended as set forth above and as proposed in the Resolution of the Township Council adopted June 25, 2013. Certified to be a true copy of the Resolution approved by the Planning Board on July 9, 2013.
