156-13 August 20, 2013 RESOLUTION WHEREAS, the Township’s Refuse and Recycling Collection Service Contract is scheduled to expire on September 8, 2013; and WHEREAS, on April 25, 2013 public notice was given of bid specifications for a new contract; and WHEREAS, the Solid Waste Advisory Committee reviewed the bid specifications and has supervised the bidding and bid award procedures in cooperation with the Purchasing Agent; and WHEREAS, on the due date and time for submission of bids for this Contract, July 23, 2013, two bids were received and opened in the Township Municipal Building; and WHEREAS, Suburban Disposal, Inc. submitted the lowest financial bid with regard to Option #1 for Refuse and Recycling Collection Services; and WHEREAS, Joseph Smentowski, Inc./Galaxy submitted the 2nd lowest financial bid for Option #1 for Refuse and Recycling Collection Services; and WHEREAS, the Township has reviewed the two bids submitted and has determined Suburban Disposal, Inc. to be the lowest responsible bidder; and WHEREAS, the Township has further determined that the bid submitted by Joseph Smentowski, Inc./Galaxy, was not only considerably higher than the bid submitted by Suburban Disposal, Inc., but that it was also not a responsive bid in that a required form titled, “Disclosure of Investment Activities in Iran” was not submitted; and WHEREAS, the Solid Waste Advisory Committee recommends awarding a contract for the following: OPTION #1 Item #1 – Refuse Collection Service for residential sources two times per week in three zones. Item #2 – Additional Refuse Collection Service; municipal sources, limited commercial collection two times per week in three zones, bulky trash collection for residential sources one time per week in three zones, litter baskets two times per week in three zones and four times per week in designated zones, refrigerants and electronic waste one time per week on a call in basis to the contractor. Item #4 – Recycling Collection Service to residents, municipal sources and limited commercial collection one time per week in three zones utilizing the single stream method. No commercial cardboard collection. OPTION #4 – Rental of Compactor Truck OPTION # 5 – Refuse Container Mechanical Pick Up

NOW THEREFORE, BE IT, AND HEREBY IT IS, RESOLVEDby the Township Council of the Township of West Orange that the Refuse and Recycling Collection Contract effective September 9, 2013 for Option #1 Items #1, #2 and #4 and Option #4 and Option #5, all as set forth at length and with specificity in the bid specifications and the response thereto submitted by Suburban Disposal, Inc., 54 Montesano Road, Fairfield, NJ 07004 is awarded to Suburban Disposal Inc. for a period of five (5) years; and it is further RESOLVED, that the Mayor and Municipal Clerk are hereby authorized to execute and attest to the execution of all appropriate documents to effectuate the award of this bid as referred to herein; and it is further RESOLVED, that the Municipal Clerk is hereby directed to cause notice of this award to be published in accordance with applicable law and shall maintain a copy of the Contract on file for public inspection.
