51-22 March 15, 2022 RESOLUTION AUTHORIZING THE DISPOSAL OF EQUIPMENT WHEREAS, the Fire Official has advised the Purchasing Agent that there is unsafe and obsolete equipment that is no longer needed for public use which has surpass its useful life expectancy. WHEREAS, N.J.S.A. 40A:11-36 authorizes the disposition of personal property not needed for public use without public sale when the fair value of the property is less than $6600.00 (15 percent of the bid threshold); and WHEREAS, the equipment set forth on the attached Exhibit "A", have a value of less than $6600.00; and WHEREAS, it is in the best interest of the Township to dispose of equipment as they have not passed the minimum testing standards, and cannot be repaired. NFPA states if the hose cannot be repaired, the hose needs to be condemned; and NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of West Orange, in the County of Essex, New Jersey that the obsolete equipment referenced by the Fire Official which is no longer needed for public use by the Township shall be disposed of according to the manner as prescribed by law.
