2681-22 AN ORDINANCE AMENDING CHAPTER 7-12 CONCERNING STREET CLEANING AND MAINTENANCE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that the Township’s Ordinance §7-12 concerning Street Cleaning and Maintenance in the Township of West Orange be and is hereby amended as follows: I. PURPOSE The purpose of this ordinance is to amend the Street Cleaning and Maintenance Ordinance to ensure compliance so that the Township’s neighborhoods and streets are free of litter, debris, and other waste which constitutes a potential blight on the Township. II. §7-12 BE AND IS HEREBY AMENDED AS FOLLOWS: The portion entitled “Hours and Days” which specifies specific days and hours shall be repealed and replaced by the following language: Hours and Days shall be fixed from time to time by Resolution duly adopted by the Township Council. The current section of §7-12 shall be designated §7-12.1. A new §7-12.2 shall be added as follows: 1. Besides existing fines and sanctions, any violation of this Section shall be subject to an additional $50 “Clean West Orange Assessment” which money shall be used to ensure the cleanliness of the Township including maintaining the Township’s quality of life. A new §7-12.3 shall be added as follows: 1. Besides all other fines, sanctions and assessments, the Police or any other parking enforcement authority which may exist shall be authorized to tow any vehicle found in violation of this Section in accordance with §7.3. III. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. IV. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance.

3 2681-22 LEGISLATIVE HISTORY The purpose of this Ordinance is to amend the existing Street Cleaning and Maintenance Ordinance to ensure compliance. Specifically, the quality of life and overall appearance of the Township are impacted when the Department of Public Works is not able to effectively sweep and clean streets. Streets are marked with appropriate signage and enforcement efforts via issuance of summonses have occurred. Unfortunately, non-compliance continues and this negatively impacts neighborhoods and the entire Township.
