180-13 September 17, 2013 RESOLUTION AUTHORIZING COMPETITIVE CONTRACTING FOR EMERGENCY MEDICAL SERVICES WHEREAS, the Township of West Orange (“Township”) provides emergency medical first aid, basic life support, and ambulance transport services to its residents and visitors through the Township’s Fire Department and, additionally, with the support and assistance of the West Orange Volunteer First Aid Squad (the “First Aid Squad”); and WHEREAS, the First Aid Squad no longer operates on a strictly volunteer basis; and WHEREAS, the Township intends to continue to use its Fire Department for emergency medical first aid, basic life support, and ambulance transport services, but now requires a competitive process with respect to the operation of a third party emergency medical service which will provide additional support and assistance to residents and visitors to the Township; and WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., has a procedure for the award of contracts by competitive contracting in lieu of public bidding wherein proposals are evaluated and ranked in a methodology by scoring in the categories of technical, management and cost related criteria; and WHEREAS, N.J.S.A. 40A:11-4.1(f) of the Local Public Contracts Law authorizes the use of competitive contracting in lieu of public bidding for the hiring of a third party entity which provides emergency medical services; and WHEREAS, the Township’s Legal Department has determined that in order to secure the services of a third party which provides emergency medical first aid, basic life support, and ambulance transport services, a request for such services must be done consistent with the provisions of the Local Public Contracts Law; and

WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, a resolution of the governing body is required to authorize the use of competitive contracting when specialized goods or services are desired to be contracted; NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange, that the Township is authorized to use the competitive contracting process to solicit and consider proposals for the provision of emergency medical first aid, basic life support, and ambulance transport services in the Township, consistent with the requirements of N.J.S.A. 40A:11-4.4 and other applicable provisions of the Local Public Contracts Law.
