672-21 July 13, 2021 WEST ORANGE ABC BOARD AMENDED RESOLUTION #672-21 TO REFLECT APPROVAL OF PERSON-TO-PERSON TRANSFER OF ABC LICENSE 0722-33-021-004 FROM 4 CORNERS DELI, LLC, TO DONATO REALI, (POCKET LICENSE) NUNC PRO TUNC FOR OCTOBER 24, 2019 WHEREAS, 4 Corners Deli, LLC is the holder of Plenary Retail Consumption License No. 0722-33-021-004; and WHEREAS, Donato Reali, 79 S. Valley Road, West Orange, NJ, has made application for a person-to-person transfer for the above-mentioned license; and WHEREAS, the principal has been investigated by the Township Police Department with no impediments to an interest in an alcoholic beverage license; and WHEREAS, due notice of the proposed transfer was published in the West Orange Chronicle on January 23, 2020 and January 30, 2020 and appropriate fees have been paid by the applicant to the NJ Division of Alcoholic Beverage in the amount of $200.00 and to the Township of West Orange in the amount of $113.52; and WHEREAS, for historical purposes it is noted that a prior owner/operator holding this license under the name 4 Corners Deli, LLC, t/a Don Juan Restaurant, at 55 Kingsley Street, West Orange, NJ, facing numerous charges of ABC violations and failing to pay taxes owed to the State of New Jersey, resulted in seizure of the License by the Division of Taxation and auction of the License in October, 2019, specifically on October 24, 2019, to satisfy those taxes, the License then held in Pocket status; and WHEREAS, a public hearing was conducted on July 13, 2021 and no one appeared in opposition thereto; and WHEREAS, Alan J. Markman, Esq., attorney for the transferee presented the application to the ABC Board on July 13, 2021 and was available to answer any questions posed by the Board; NOW THEREFORE BE IT RESOLVED that the Township Council of the Township of West Orange hereby authorizes the person-to-person transfer of Plenary Retail Consumption License No. 0722-33-021-004 from 4 Corners Deli, LLC, to Donato Reali, 79 S. Valley Road, West Orange, NJ, and such transfer is hereby approved nunc pro tunc for October 24, 2019. _______________________________________ _____________________________ Karen J.
