678-22 May 24, 2022 WEST ORANGE ABC BOARD RESOLUTION APPROVING RENEWAL OF LICENSE #0722-33-021-004, 4 CORNERS DELI, LLC, NUNC PRO TUNC FOR 2019-2020 LICENSE TERM WHEREAS, until on or about October 24, 2019, 4 Corners Deli, LLC, t/a Don Juan Restaurant, was the holder of Plenary Retail Consumption License No. 0722-33-021-004; and WHEREAS, on or about July 26, 2019, said Licensee had applied for renewal of its License, indicating payment of required municipal and State fees; and WHEREAS, West Orange Municipal Clerk and ABC Clerk, Karen Carnevale, had been notified by letter from the State of New Jersey, Division of Taxation, that said License had been seized by the Division of Taxation on June 11, 2019, pursuant to R.S. 33:1-26 and N.J.S.A. 54:99-13A, and therefore believing that the License could not then be renewed; and WHEREAS, after the beginning of the 2019-2020 License Term, Plenary Retail Consumption License No. 0722-33-021-004 was auctioned by the Division of Taxation on October 24, 2019, the taxes then due and owing paid to the State of New Jersey from the proceeds of the auction, and the License then qualifying for renewal for the 2019-2020 License Term; and WHEREAS, the State of New Jersey Division of Alcoholic Beverage Control and its Licensing Bureau have requested and instructed the Township to now approve nunc pro tunc to July 1, 2019, the renewal of Plenary Retail Consumption License No. 0722-33-021-004, for the 2019-2020 License Term; and WHEREAS, a public hearing was held before the Township of West Orange ABC Board on May 24, 2022, and no one appearing in opposition to the license renewal; NOW THEREFORE BE IT, AND IT IS HEREBY, RESOLVED that the Township Council of the Township of West Orange authorizes and wishes to renew nunc pro tunc for July 1, 2019, the Plenary Retail Consumption License No. 0722-33-021-004, for 4 Corners Deli, LLC, t/a Don Juan Restaurant for the 2019-2020 License Term. _______________________________________ _____________________________ Karen J.
