679-22 May 24, 2022 WEST ORANGE ABC BOARD RESOLUTION RENEWING ABC LICENSE #0722-33-021-004, FOR DONATO REALI (POCKET LICENSE) FOR THE 2020-2021 LICENSE TERM WHEREAS, until on or about October 24, 2019, 4 Corners Deli, LLC, t/a Don Juan Restaurant, was the holder of Plenary Retail Consumption License No. 0722-33-021-004; and WHEREAS, on or about July 26, 2019, said Licensee had applied for renewal of its License, indicating payment of required municipal and State fees; and WHEREAS, West Orange Municipal Clerk and ABC Clerk, Karen Carnevale, had been notified by letter from the State of New Jersey, Division of Taxation, that said License had been seized by the Division of Taxation on June 11, 2019, pursuant to R.S. 33:1-26 and N.J.S.A. 54:99-13A, and therefore believing that the License could not then be renewed; and WHEREAS, the State of New Jersey Division of Alcoholic Beverage Control and its Licensing Bureau have requested and instructed the Township to take specific steps with respect to Plenary Retail Consumption License No. 0722-33-021-004, to correct and update certain previous renewals and the transfer of the License to Donato Reali, all such steps designed to take into account the seizure of the License for non-payment of taxes and subsequent auction of the License to satisfy those taxes owed; and WHEREAS, the State of New Jersey Division of Alcoholic Beverage Control and its Licensing Bureau have requested and instructed the Township to now approve the renewal of Plenary Retail Consumption License No. 0722-33-021-004, for Donato Reali, 79 S. Valley Road, West Orange, NJ, a pocket license, for the 2020-2021 License Term; and WHEREAS, a public hearing was held before the Township of West Orange ABC Board on May 24, 2022, and no one appearing in opposition to the license renewal; NOW THEREFORE BE IT, AND IT IS HEREBY, RESOLVED that the Township Council of the Township of West Orange authorizes and wishes to renew for July 1, 2020, the
