220-22 September 6, 2022 R E S O L U T I O N WHEREAS, in November 10, 2021 an acoustic precision evaluation was performed on the 2,000-gallon underground storage diesel tank and associated piping to conform to U.S.E.P.A. and N.J.D.E.P tank testing criteria located at the Cherry Lane Pump Station; and WHEREAS, the results of the acoustic precision evaluation for the underground storage diesel tank failed; WHEREAS, the acoustical profile indicate there is a leak above or below the liquid level is the cause of the test failure; and WHEREAS, the possible options for investigating the cause of failure are costly and replacement of the tank may be warranted; and WHEREAS, the Township and its Department of Public Works received a proposal from T Slack Environmental Services to remove the one (1) 2,000-gallon diesel underground storage tank (UST) and to install one (1) 2,000-gallon diesel aboveground storage tank (AST) at Cherry Lane Pump Station through New Jersey State Contract #A42266; and WHEREAS, T Slack Environmental Services of Kenilworth provided a cost proposal in the amount of $75,073.99 on August 3, 2022 for the removal of the 2,000-gallon diesel UST and replacement of the 2,000-gallon diesel with an AST; and WHEREAS, the Township Engineer by letter dated August 24, 2022 recommends entering into a contract with T Slack Environmental Services; and WHEREAS, pursuant to the provision made in the Local Public Contracts Law N.J.S.A. 40A:11-5(2) the Township as a Local Government Unit, may without public advertising for goods or services, enter into contracts already secured by the United States of America, the State of New Jersey, County or Municipality thereof; and WHEREAS, the cost proposal and product specifications are satisfactory to the Department of Public Works; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing.
NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that a contract for the removal of the UST and replacement of the 2,000-gallon diesel tank with an AST be awarded to T Slack Environmental Services, 180 Market Street, Kenilworth, NJ 07033 in accordance with their proposal dated August 3, 2022 in the amount of $75,073.99 for services at the Township’s Cherry Lane Pump Station.
