191-13 October 1, 2013 RESOLUTION WHEREAS, AMPC Real Estate (“AMPC”) owns certain real property and any improvements located thereon, located at Block 155, Lot 26.02 in the Township of West Orange, also known as 471-475 Prospect Avenue; and WHEREAS, AMPC overpaid its taxes for the year 2012 because of a change to the block and lot designation for the same parcel from the assessor which resulted in AMPC’s first and second quarter payments from the original block and lot not being credited to the new designation; and WHEREAS, the Township’s Tax Collector has stated that the amount paid to the Township by AMPC for the fourth quarter of 2012 represented an overpayment of $133,155.21, as reflected on the spreadsheet annexed hereto as Attachment “A”; and WHEREAS, AMPC paid that sum to the Township and is entitled to a refund of that amount; NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of West Orange as follows, that the Tax Collector and Chief Financial Officer of the Township of West Orange be and hereby are authorized, empowered and directed to issue a refund to AMPC for their overpayment of real estate taxes for the 1st and 2nd quarter of 2012, totaling $133,155.21., and cancelling the taxes for the 1st and 2nd quarter of 2012 on the original block and lot.
