270-22 October 25, 2022 R E S O L U T I O N WHEREAS, by Resolution No. 165-18 dated June 26, 2018, the Township Council awarded the Contract MA-2016 Improvements to Curtis Avenue and Garfield Avenue project to A & J Contractors Group, Inc., Monroe, NJ in the amount of $661,454.00 with an option to award Supplemental Bid “A” in the amount of $33,452.00 within 120 days of the Base Bid; and WHEREAS, the Township Council by Resolution No. 268-18 dated December 11, 2018 awarded Supplemental Bid Item “A” in the amount of $33,452.00 for storm sewer construction between No. 33 and 37 Curtis Avenue bringing the total contract amount to $694,906.00; and WHEREAS, by the same Resolution No. 268-18 the Township authorized Change Order No. 1 in the amount of $28,000.00 to change pipe materials from 24-inch diameter concrete pipe to 19-inch by 30- inch elliptical concrete pipe bringing the total contract amount to $722,906.00; and WHEREAS, the Township Engineer by letter dated May 7, 2019 recommended Change Order No. 2 in the amount of $100,000.00 to allow additional work at the unit price bid for the milling and resurfacing of Old Indian Road from Pleasant Valley Way to St. Cloud Avenue; and WHEREAS, the New Jersey American Water Company (NJAWC) contributed about two thirds the cost of this additional work; and WHEREAS, the Township Engineer by letter dated September 28, 2022 recommends Change Order No. 3 in the amount of $291.57 to account for the Fuel Price Adjustment calculation for Project Close-Out process with the New Jersey Department of Transportation. WHEREAS, sufficient funds exist for this additional work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that Change Order No. 3 for the project MA-2016 Improvements to Curtis Avenue and Garfield Avenue project with A & J General Contractors Group, Inc., 105 Federal Building, Monroe Township, New Jersey 08831 in the amount of $291.57 or a 18.46 percent increase in the original contract amount is hereby approved bringing the adjusted contract amount to $823,197.57. BE IT FURTHER RESOLVED that the Municipal Engineer is authorized to execute the Change
