295-22 November 22, 2022 R E S O L U T I O N WHEREAS, Public Works Supervisor, Louis Reynolds advised the Public Works Director and Municipal Engineer, Leonard R. Lepore, that the spillway on the West Fork, East Branch of the Rahway River is in danger of collapsing and needs immediate repair; and WHEREAS, Supervisor Reynolds obtained a proposal dated October 25, 2022 from Grabowski Construction Inc. of 770 Northfield Avenue to reconstruct the spillway and construct an emergency access roadway; and WHEREAS, the cost of the work is estimated to be $49,810.00 with exclusions; and WHEREAS, the Municipal Engineer pursuant to N.J.S.A. 40A:11.6a notified the Purchasing Agent, Paula Reynolds, on November 1, 2022 of the need to perform emergency construction on the spillway; and WHEREAS, the Municipal Engineer advised the Purchasing Agent that the estimated cost with exclusions and contingencies is $65,000.00 or $15,190.00 more than the proposal; and WHEREAS, the Municipal Engineer by letter dated November 1, 2022 recommends paying the cost of this emergency work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in the amount up to $65,000.00 is authorized to pay Grabowski Construction for emergency spillway reconstruction adjacent to Glen Road on the West Fork, East Branch of the Rahway River.

BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
