296-22 November 22, 2022 R E S O L U T I O N WHEREAS, construction of a sanitary sewer on “upper” Mellon Avenue requires the immediate reconstruction of “upper” Mellon Avenue; and WHEREAS, the Municipal Engineer obtained a proposal dated October 13, 2022 from Grabowski Construction Inc. of 770 Northfield Avenue, West Orange, NJ to grade and pave “upper” Mellon Avenue; and WHEREAS, the cost of the work is estimated to be $40,317.00 without contingencies; and WHEREAS, the Municipal Engineer pursuant to N.J.S.A.40A:11.6a notified the Purchasing Agent, Paula Reynolds, on November 1, 2022 of the need to perform emergency paving of “upper” Mellon Avenue; and WHEREAS, the Municipal Engineer advised the Purchasing Agent that the estimated cost with contingencies is $50,000.00 or $9,683.00 more than the proposal; and WHEREAS, the Municipal Engineer by letter dated November 1, 2022 recommends paying the cost of this emergency work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in the amount up to $50,000.00 is authorized to pay Grabowski Construction to pave “upper” Mellon Avenue.

BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
