302-22 RESOLUTION WHEREAS, by Resolution No. 315-21 dated December 14, 2021, the Township Council awarded the Contract MA-2020 Arverne Road, Crestmont Road (portion) and Westover Terrace (portion) Improvement project to Cifelli & Son General Contracting, 81 Franklin Avenue, Nutley, NJ 07110 in the amount of $873,652.41; and WHEREAS, the work under this contract included street improvements consisting predominantly of asphalt pavement milling and resurfacing, curb replacement, driveway aprons, ADA accessible curb ramps and minor drainage improvements to three (3) Municipal Streets or parts thereof; and WHEREAS, supplemental items were needed in the contract for drainage improvements; and WHEREAS, the asphalt cement and fuel price index are escalating at a high percentage since the project was awarded; and WHEREAS, the Municipal Engineer by letter dated June 8, 2022 recommended additional funding in the amount of $159,266.83 to complete the work; and WHEREAS, by Resolution No. 154-22 dated June 14, 2022 the Township Council approved Change Order No. 1; and WHEREAS, by letter dated July 8, 2022, the Municipal Engineer recommended approval of the Final Accounting of As Built Quantities for this project in the amount of $44,515.18 or a 4.31 percent increase over the previously authorized amount; and WHEREAS, by Resolution 191-22 dated July 19, 2022, the Township Council approved the Final Accounting of As Built Quantities for a total increase of $203,782.01 or 23.33 percent bringing the total contract amount to $1,077,434.42; and WHEREAS, the Municipal Engineer by letter dated November 15, 2022 recommends additional Change Order No. 3 and Final in the amount of -$195,00 which reflects the final As Built Quantities bringing the final contract amount to $1,077,239.42 or 23.30 percent increases over the original contract amount; WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that the Change Order No. 3 and Final for the project MA-2020 Arverne Road, Crestmont Road (portion) and Westover Terrace (portion) Improvement Project with Cifelli & Son General Contracting, 81 Franklin Avenue, Nutley, NJ 07110

302-22 in the amount of -$195.00 resulting in a final total increase of $203,587.01 or a 23.30 percent increase down from $203,782.01 or 23.33 percent increase over the original contract award amount of $873,652.41. BE IT FURTHER RESOLVED that the Municipal Engineer is authorized to execute the Change Order on behalf of the Township of West Orange. Karen J.
