1 9-23 January 10, 2023 RESOLUTION WHEREAS, the Township seeks to retain counsel to represent the Township and Planning Board with regard to a certain action entitled Bel Air at West Orange Condominium Association v. Township of West Orange and Township of West Orange Planning Board; and WHEREAS, the Township seeks to retain Diana McGovern, Esq. of Zimmerer, Murray, Conyngham & Kunzier to provide these services; and WHEREAS, Diana McGovern, Esq. has extensive experience with regard to representing similar Townships and Planning Board; and WHEREAS, Ms. McGovern has agreed to an hourly rate of $175 with fees and expenses not to exceed $10,000. NOW, THEREFORE, BE IT RESOLVED that the Township Council hereby authorizes the Township to retain Diana McGovern, Esq. of Zimmerer, Murray, Conyngham & Kunzier at a rate of $175 per hour up to a maximum expense of $10,000; and BE IT FURTHER RESOLVED that the Business Administrator is hereby authorized to execute any retainer agreement to retain Ms. McGovern and the Township Clerk is hereby authorized to attest to the Business Administrator’s signature; and RESOLVED that notice of this award shall be available in the Clerk’s office in accordance with applicable law.
