30-24 January 9, 2024 R E S O L U T I O N WHEREAS, in early December 8th 2023, the Township’s Sewer Division determined the 8-inch clay sanitary main pipe located behind No. 10 Burnett Terrace within the Township’s 5-foot Right-of- Way sewer easement revealed the sewer line had collapsed; and WHEREAS, to avoid any additional collapse of the sewer pipe and compromise the structural integrity of the wall within the vicinity of the sanitary sewer main, the Engineering Department decided to replace the sewer pipe, and restore ground area; and WHEREAS, pursuant to the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11.6a the Assistant Municipal Engineer on December 11, 2023 notified the Administration and Purchasing Agent of the need to perform an emergency contract for this work with a total estimated cost of $14,000.00; and WHEREAS, it was concluded that to expedite the work and to perform the emergency repair of the sanitary sewer pipe behind No. 10 Burnett Terrace within the Township’s 5-foot Right-of-Way to protect public health and safety an emergency contract would be issued to Shauger Property Services, Inc.; and WHEREAS, Shauger Property Services, Inc. submitted a proposal dated December 27, 2023 for the emergency repair of the sanitary sewer in the amount of $13,979.97; and WHEREAS, the Assistant Municipal Engineer by letter dated January 3, 2024 recommends paying the costs of this emergency work; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in an amount not to exceed $13,979.97 without authorization is authorized to Shauger Property Services, Inc. for emergency sanitary sewer construction to the Township’s sanitary sewer main located behind No. 10 Burnett Terrace within the Township’s 5-foot Right-of-Way.
BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
