36-24 January 9, 2024 R E S O L U T I O N WHEREAS, County Route 659 (Main Street) is a densely developed and thriving residential and business corridor traversing the Township of West Orange with significant pedestrian and bicycle traffic; and WHEREAS, County Route 659 (Main Street) and the adjacent streets have a mix of business and residential uses and it is heavily travelled by pedestrian traffic on a daily basis; and WHEREAS, Mayor McCartney and the Township Council of the Township of West Orange are deeply concerned about pedestrian safety along County Route 659 (Main Street); and WHEREAS, the West Orange Engineering Department and the Essex County Department of Public Works and Engineering Division determined that the crosswalks at the intersection of Franklin Avenue and Main Street, Charles Street and Main Street and Northfield Avenue near St. Mark’s Church are in need of an emergency repair; and WHEREAS, pursuant to the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11.6a the Assistant Municipal Engineer on November 8th, 2023 and December 5th, 2023 notified the Administration and Purchasing Agent of the need to perform an emergency contract for this work with a total estimated cost of $65,000.00 to $100,000.00 which is above the bid threshold; and WHEREAS, it was concluded that to expedite the work and to perform the emergency repair of the crosswalks at the intersection of Franklin Avenue and Main Street, Charles Street and Main Street and Northfield Avenue near St. Mark’s Church to protect public health and safety, an emergency contract would be issued to Essex & Morris Contracting Co., 12 Candice Way, East Hanover, NJ 07936 and was readily available to perform the work; and WHEREAS, Essex & Morris Contracting Co. submitted an invoice dated December 22, 2023 for the emergency repair for the crosswalks at the intersection of Franklin Avenue and Main Street, Charles
Street and Main Street and damaged brick paver walkway in front of No. 429 Main Street in the amount of $56,282.92; and WHEREAS, the Assistant Municipal Engineer by letter dated January 3, 2024 recommends paying the costs of this emergency work; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in an amount $56,282.92 is authorized to Essex & Morris Contracting Co., 12 Candice Way, East Hanover, NJ 07936 for emergency repair of the crosswalks at the intersection of Franklin Avenue and Main Street, Charles Street and Main Street and damaged brick paver walkway in front of No. 429 Main Street. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
