730-24 January 9, 2024 RESOLUTION OF THE WEST ORANGE TOWNSHIP ABC BOARD RESOLUTION RESCINDING IN PART ABC RESOLUTION NO. 724-23 REMOVING LICENSE NO. 0722-33-006-009 MISTY’S RESTAURANT AND BAR, INC AS A LICENSEE APPROVED FOR RENEWAL FOR THE 2023-2024 LICENSE TERMS FOR FAILURE TO RENEW 2022-2023 LICENSE WHEREAS, the Clerk of the West Orange ABC Board, believing that the following NJ ABC Licensee, License No. 0722-33-006-009 Misty’s Restaurant and Bar, Inc., was qualified for renewal of said License for the 2023-2024 License Terms, according to her records having applied and paid all fees due for renewal of the License and believing all other requirements to have been met as well; and WHEREAS, that the Licensee was therefore included with others on West Orange Township ABC Board Resolution No. 724-23, adopted by the ABC Board at its regular meeting on August 1, 2023 renewing for the 2023/24 license term; and WHEREAS, the Clerk having realized the licensee failed in fact to qualify for renewal in 2022-2023, in that the Licensee neglected to obtain Tax Clearance. Therefore, the license was not renewed for the 2022-2023 license term. Such failures and deficiencies require rescission of the Township’s annual approval for License No. 0722-33-006-009 Misty’s Restaurant and Bar, Inc., for license term 2023-2024; NOW, THEREFORE, BE IT AND IT HEREBY IS RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, SITTING IN ITS CAPACITY AS THE WEST ORANGE TOWNSHIP ABC BOARD, that the portion of West Orange Township ABC Resolution No. 724-23 setting forth as qualified for renewal and renewing License No. 0722-33-006-009 Misty’s Restaurant and Bar, Inc., for the 2023-2024 License Term, is to that extent and that extent only, hereby rescinded, excising that Licensee from the list of those which were to be renewed for the respective License term, all in accordance with instructions received by and on behalf of the New Jersey ABC Licensing Bureau. ____________________________________ __________________________________ Karen J.
