99-24 March 26, 2024 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) is the owner of real property known as Block 170, Lots 13, 15.03 and 17 on the Tax Map of the Township commonly known as 590 Mt. Pleasant Avenue (the “Property”); and WHEREAS, the Township of West Orange Recycling Center (the “Recycling Center”) is located and operates on the Property; and WHEREAS, Township utilizes the Recycling Center as an integral part of its Recycling Program; and WHEREAS, the Management, Operation and Maintenance Service Agreement for the Recycling Center between the Township and Natures Choice NJ, LLC (“Natures Choice”) with offices at 1106 Millstone River Road, Hillsborough, New Jersey 08844 formerly operating as Reliable Wood Products, LLC expired on February 29, 2024; and WHEREAS, the award of a new Contract for Operation of the Recycling Center is pending before the Township Council and is scheduled to commence on May 1, 2024; and WHEREAS, pursuant to N.J.S.A. 40A:11-15 of the Local Public Contracts Law, the Township and Natures Choice have agreed to extend the Agreement until April 30, 2024 when the new Contract for Operation of the Recycling Center shall commence by way of the Temporary Extension Agreement for the Management, Operation and Maintenance Services for the West Orange Recycling Center and Compost Facility, annexed hereto as Exhibit “A.” NOW, THEREFORE BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that the Mayor is authorized to execute the Temporary Extension Agreement for the Management, Operation and Maintenance Services for the West Orange Recycling Center and Compost Facility, annexed hereto as Exhibit “A;” and be it further RESOLVED that notice of this temporary extension shall be available in the Clerk’s office in accordance with applicable law.
