5-26 January 6, 2025 A RESOLUTION REJECTING THE BIDS RECEIVED FOR THE 2026 TREE PLANTING AT VARIOUS LOCATIONS CONTRACT AND AUTHORIZING THE DIRECTOR OF PURCHASING TO RE-BID THE 2026 TREE PLANTING AT VARIOUS LOCATIONS CONTRACT WHEREAS, on November 14, 2025, the Township of West Orange received bids for the 2026 Tree Planting at Various Locations contract; and WHEREAS, the Township of West Orange Township Council has determined that substantial and substantive revisions to the bid specifications are required; and WHEREAS, N.J.S.A. 40A:11-13.2(d) allows for the rejection of all bids by a municipality where substantial and substantive revisions to the specifications for services must be made; and WHEREAS, it is the recommendation of the Township Council that the bids received for the 2026 Tree Planting at Various Locations contract be rejected and the contract be re-bid after substantial revisions to the specifications are made, specifically changing the nature of the tree installation; and NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Orange that the bids received for the 2026 Tree Planting at Various Locations contract are hereby rejected in accordance with the provisions of N.J.S.A. 40A:11-13.2d; and BE IT FURTHER RESOLVED that the Director of Purchasing is hereby authorized to re-bid the 2026 Tree Planting at Various Locations contract for the sought-after provision or performance of goods and services after substantial and substantive revisions to the specifications are made. BE IT FURTHER RESOLVED that the Township shall re-advertise the Bid Contract in accordance with N.J.S.A. 40A:11-23 and contact all bidders who responded to the Bid Contract and advise them of the re-bid; and BE IT FURTHER RESOLVED, that this Resolution shall be made available in the Clerk’s Office for reasonable inspection in accordance with applicable law.
