2980-26 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7 “TRAFFIC,” SECTION ______ OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE TO ESTABLISH A RESIDENTIAL PERMIT PARKING AT NUTMAN PLACE, OSBORNE PLACE, PILLOT PLACE, QUINBY PLACE, RIGGS PLACE AND SWAINE PLACE FOR A LIMITED TIME PURSUANT TO A PILOT PROGRAM WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient administration of government services; and WHEREAS, Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place, and Swaine Place endure significant traffic flow and pedestrian activity, which has caused difficulty for many residents that live on those streets to find parking; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, current parking regulations on Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place, and Swaine Place restrict parking to one side of the street due to insufficient roadway width; and WHEREAS, the Governing Body of the Township of West Orange finds that it is necessary for the public health, safety and welfare of the municipality and its inhabitants to explore innovative solutions to respond to the residents’ parking demands in the Valley section; and WHEREAS, the Governing Body of the Township of West Orange desires to implement a Residential Permit Parking Pilot Program (the “Pilot Program”), effective from September 1, 2026, to automatically terminate on December 1, 2026, to temporarily permit parking on Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place, and Swaine Place only to residents of those streets who are approved by application and obtain a Permit Parking Decal, to assess the feasibility and viability of permanent permit parking on Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place, and Swaine Place;
cation and obtain a Permit Parking Decal, to assess the feasibility and viability of permanent permit parking on Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place, and Swaine Place; and WHEREAS, the Governing Body has directed the appropriate departments to take all necessary actions to implement the Pilot Program, including signage adjustments and public outreach efforts to inform residents, businesses, and stakeholders; and
WHEREAS, observations from the West Orange Police Department has been directed to detail the outcomes of the Pilot Program shall be presented to the Governing Body for review and consideration within 60 days of initiating the Pilot Program and prior to the end of the Pilot Program; and NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Council of the Township of West Orange, in the County of Essex, State of New Jersey, being the governing body thereof, that Section 47 “Residential Permit Parking Pilot Program” of Chapter 7 “Traffic,” shall be created as follows. Section 1. RECITALS. The foregoing whereas clauses are incorporated herein by reference and made a part hereof. Section 2. Chapter 7, “Traffic,” Section 47 “Residential Permit Parking Pilot Program” is hereby created as follows: §7-47.1 DEFINITIONS Permit Parking Zone #12 shall mean and refer to permit parking on Nutman Place, Osborne Place, Pillot Place, Quinby Place, Riggs Place and Swaine Place. Residential Parking Decal shall mean and refer to a sticker which shall be placed on the back driver’s side window of a vehicle which designates the vehicle which the sticker is upon as an approved vehicle under the Residential Parking Permit Pilot Program. All decals will identify the Municipality-Township of West Orange, New Jersey; the type of permit-On Street Residential Parking Permit; the Zone Number; and the Permit Number. Residential Permit Parking Pilot Program shall mean and refer to a temporary program for residential permit parking that shall have a set start and end date for the Township to evaluate parking upon specific streets subject to such temporary program. §7-47.2 PERMIT PARKING ZONE 12 A. A Residential Permit Parking Pilot Program in Permit Parking Zone #12 shall be in effect from September 1, 2026 through December 1, 2026. B. Residential Parking Decals shall be limited to one Residential Parking Decal per residential unit, on a first-come, first-served basis, for the entire length of each street within Permit Parking Zone #12. Participation in the Residential Permit Parking Pilot Program requires the filing of an application for a Residential Parking Decal on PDLinx.App/ParkingPermit. Applications shall become available on August 10, 2026. 1. Along with the application, residents must submit proof of residency and a valid vehicle registration.
C. Restrictions. 1. Approval for a Residential Parking Decal does not guarantee or reserve a parking space, but grants permission to legally park on the roadways in question should a legal spot be available; 2. Parking spaces within Permit Parking Zone #12 are available on a first come, first-served basis for Residential Parking Decal holders; and 3. Parking is prohibited within Permit Parking Zone #12 as otherwise designated by law or as restricted or prohibited pursuant to the Revised Ordinances of the Township of West Orange, including, but not limited to, loading zones, fire hydrants, alternate side parking, limited hours, handicapped or restricted parking zones, or as otherwise prohibited under Title 39. 4. No vehicle may park in such a way to block any portion of any driveway. 5. All provisions which regulate parking of vehicles for the purpose of street sweeping and/or snow removal remain in effect. D. Enforcement. 1. The following sections of the Revised General Ordinances for the Township of West Orange shall not be enforced while the Residential Permit Parking Pilot Program for Permit Parking Zone #12 is in effect: i. 7-11 as applies to Quinby Place ii. 7-14.2A as applies to Osborne Place 2. The aforementioned sections of the Revised General Ordinances for the Township of West Orange shall be restored without further action as of December 1, 2026 E. Expiration. This Code Section and the Residential Parking Permit Pilot Program for Permit Parking Zone #12 shall expire on December 1, 2026. §7-47.3 Violations. No person shall park a vehicle upon any of the streets herein described, except by permit. Any person who violates any provision of § 7-47 shall, upon conviction thereof, be punished by a fine of $50 for each such violation, and each day in which such violation continues shall constitute a separate violation or offense.
Section 3. If any provision of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any other provisions or applications of this Ordinance that can be given effect without the invalid provision(s) or application(s) and to this end the provisions of this Ordinance are severable. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 4. This Ordinance shall take effect upon final passage and publication in accordance with law. NOTICE NOTICE IS HEREBY GIVEN, that the above Ordinance was introduced and passed on first reading at the regular meeting of the Township Council of the Township of West Orange, County of Essex, State of New Jersey held in the Municipal Building on the 7th day of July, 2026, and the same came up for final passage at the regular meeting of the Township Council held on the 21st day of July, 2026, at which time, after persons interested were given the opportunity to be heard concerning said Ordinance, the same was passed and will be in full force and effect in the Township of West Orange after approval by the Mayor or in accordance with law.
