2987-26 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7 “TRAFFIC,” OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE TO ESTABLISH SECTION 47, “RESIDENTIAL PERMIT PARKING ZONE #12,” TO CREATE A NEW RESIDENTIAL PERMIT PARKING DISTRICT FOR RIGGS PLACE, PILLOT PLACE, SWAINE PLACE, AND QUINBY PLACE, AND ON ROLLINSON ROAD FROM THE CORNER OF ROLLINSON ROAD AND HAZEL AVENUE TO THE CORNER OF ROLLINSON ROAD AND SOUTH VALLEY ROAD WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient administration of government services; and WHEREAS, Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road endure significant traffic flow and pedestrian activity, which has caused difficulty for many residents that live on Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road to find parking; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, the Governing Body of the Township of West Orange finds that it is necessary for the public health, safety and welfare of the municipality and its inhabitants to explore innovative solutions to respond to the residents’ parking demands on Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road; and WHEREAS, the Governing Body of the Township of West Orange desires to implement Residential Permit Parking Zone #12 ( “Permit Parking Zone #12”) to relieve the parking burden for residents of Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road

plement Residential Permit Parking Zone #12 ( “Permit Parking Zone #12”) to relieve the parking burden for residents of Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road; and WHEREAS, the Governing Body has directed the appropriate departments to take all necessary actions to implement Permit Parking Zone #12, including signage adjustments and public outreach efforts to inform residents, businesses, and stakeholders; and NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Council of the Township of West Orange, in the County of Essex, State of New Jersey, being the governing body thereof, that Section 47 “Residential Permit Parking Program” of Chapter 7 “Traffic,” shall be created as follows. Section 1. RECITALS. The foregoing whereas clauses are incorporated herein by reference and made a part hereof.

Section 2. Chapter 7, “Traffic,” Section 47 “Residential Permit Parking Zone #12 ” is hereby created as follows: §7-47.1 DEFINITIONS Permit Parking Zone #12 shall mean and refer to permit parking on Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road. Residential Parking Decal shall mean and refer to a sticker which shall be placed on the back driver’s side window of a vehicle which designates the vehicle which the sticker is upon as an approved vehicle under the Residential Parking Permit Parking Zone #12 . All decals will identify the Municipality-Township of West Orange, New Jersey; the type of permit-On Street Residential Parking Permit; the Zone Number; and the Permit Number. §7-47.2 PERMIT PARKING ZONE #12 A. Residential Parking Decals shall be limited to people who reside on Riggs Place, Pillot Place, Swaine Place, and Quinby Place, and on Rollinson Road from the corner of Rollinson Road and Hazel Avenue to the corner of Rollinson Road and South Valley Road (“Permit Parking Zone #12”), for up to four (4) vehicles registered or leased to licensed drivers who reside in residential units located within Permit Parking Zone #12, and up to one (1) visitor pass registered to each residential unit. 1. Participation in the Residential Permit Parking Program requires the filing of an application for a Residential Parking Decal in the manner prescribed by the West Orange Police Department, with application instructions located on the Township of West Orange website. Applications shall become available on August 26, 2026. 2. Along with the application, residents must submit proof of a valid New Jersey driver license and either a vehicle registration or lease agreement for each vehicle to be permitted, along with proof of insurance for each vehicle for which a decal is to be applied. 3. Each permit shall expire on December 31 of the year which the permit was issued, and a new permit must be applied for the following year in a manner prescribed by the West Orange Police Department, with instructions located on the Township of West Orange website. 1. Residents who have been issued a Residential Parking Decal in accordance with §7-47.2(A), may park upon any street within Permit Parking Zone #12, subject to the restrictions set forth herein. C. Restrictions. 1. Permit Parking in Permit Parking Zone #12 shall be effective from 8 am to 4 pm, Monday through Friday; 2. Approval for a Residential Parking Decal does not guarantee or reserve a parking space, but grants permission to legally park on the roadways in question should a legal spot be available; 3. Parking spaces within Permit Parking Zone #12 are available on a first come, first-served basis for Residential Parking Decal holders; and 4. Parking is prohibited within Permit Parking Zone #12 as otherwise designated by law or as restricted or prohibited pursuant to the Revised Ordinances of the Township of West Orange, including, but not limited to, loading zones, fire hydrants, alternate side parking, limited hours, handicapped or restricted parking zones, or as otherwise prohibited under Title 39. 5. No vehicle may park in such a way to block any portion of any driveway. 6. All provisions which regulate parking of vehicles in statute or code for the purpose of street sweeping and/or snow removal or otherwise, remain in effect. 7. Permit holders are prohibited from transferring, selling, or exchanging any parking permit or visitor pass for consideration with any third-parties and said permits and passes are for use for their residence only. §7-47.3 Violations. a. No person shall park any vehicle within any portion of Permit Parking Zone #12 between the hours of 8 am and 4 pm, Monday through Friday except by permit or otherwise in accordance with §§7-47.2(A) and (B). Any person who violates any provision of § 7-47 shall, upon conviction thereof, be punished by a fine of $50 for each such violation, and each day in which such violation continues shall constitute a separate violation or offense. b. Any violation of § 7-47.2(C)(7) is subject to the penalty of revocation of their parking permits and visitor pass. §7-47.4 Exceptions. Vehicles, including but not limited to, trucks, vans, cars, and delivery vehicles, which are being used to make service calls or deliveries to person(s) who are residents of a dwelling unit within Permit Parking Zone #12 are exempt from the restrictions established by 7-47 et. seq. Section 3. If any provision of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any other provisions or applications of this Ordinance that can be given effect without the invalid provision(s) or application(s) and to this end the provisions of this Ordinance are severable. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 4. This Ordinance shall take effect upon final passage and publication in accordance with law. NOTICE NOTICE IS HEREBY GIVEN, that the above Ordinance was introduced and passed on first reading at the regular meeting of the Township Council of the Township of West Orange, County of Essex, State of New Jersey held in the Municipal Building on the 11th day of August , 2026, and the same came up for final passage at the regular meeting of the Township Council held on the 18th day of August, 2026, at which time, after persons interested were given the opportunity to be heard concerning said Ordinance, the same was passed and will be in full force and effect in the Township of West Orange after approval by the Mayor or in accordance with law.
