AN EQUAL OPPORTUNITY EMPLOYER www.westorange.org 2985-26 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.1 HANDICAPPED PARKING ON STREETS, AND SUBSECTION 7-32.2 RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient administration of government services; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, the Township desires to amend Chapter 7, “Traffic,” Section 32.1, “Handicapped Parking on Streets,” and Section 7-32.2 “Restricted Parking Zones” of the Township Municipal Code to remove unneeded handicap parking and add additional handicapped parking spaces in accordance with N.J.S.A. 39:4-197; and NOW, THEREFORE, BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey as follows: BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey as follows: Section 1. Subsection 7-32.1, Handicapped Parking on Streets of the Revised General Ordinances of the Township of West Orange is hereby supplemented and amended as follows: Note: Additions are shown in bold and underline and deletions are shown as strikethrough. In accordance with the provisions of N.J.S.A. 39:4-197, the following on-street locations are designated as handicapped parking places. Such spaces are for use by persons who have been issued special identification cards or plates or placards by the New Jersey Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these places. Pursuant to N.J.S.A 39:4-197.6, Restricted Parking Zones, as defined in N.J.S.A. 39:4-207.6e, are established in front of the following residences as indicated on the Tax Maps of the Township of West Orange, at the specified locations. Parking within a specific zone is restricted to the motor vehicle issued a permit pursuant to N.J.S.A. 39:4-197.7. In accordance with N.J.S.A., 39:4-197.6 parking is permitted in the Restricted Parking Zone except when prohibited in front of the residence by other sections of this Chapter. Residence Address No. of Spaces Location 111 Chestnut Street 1 Beginning 214 feet west of the point of the westerly curbline of Orange Place extended, and extending 22 feet west. 119 Watson Avenue 1 Beginning 61 feet north of the northerly curb line of Ridge Avenue extended, and extending 20 feet north. Section 3. If any provision of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any other provisions or applications of this Ordinance that can be given effect without the invalid provision(s) or application(s) and to this end the provisions of this Ordinance are severable. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 4. AN EQUAL OPPORTUNITY EMPLOYER www.westorange.org 2985-26 LEGISLATIVE HISTORY A Restricted Parking Space will be established in front of 119 Watson Avenue for the exclusive use of the resident who is in possession of a NJMVC Disability ID and Parking Placard. This space was requested by the resident and is permissible under NJ Statutes Annotated (N.J.S.A.) 39:4-197.7. Parking is permitted in the restricted parking zone except when prohibited by other sections of Chapter 7 of the Revised General Ordinances of the Township of West Orange. Additionally, a handicapped parking space and a restricted parking space will be eliminated due to the registered residents moving away.
