1 267-26 September 29, 2026 RESOLUTION APPROVING TEMPORARY EASEMENT AND ACCESS AGREEMENT WITH H&L ORANGE LLC FOR EMERGENCY STORMWATER REPAIRS WHEREAS, the Township of West Orange Engineer has determined that there are emergency repairs needed to mobilize, excavate, and reconstruct drainage improvements to the outfall stormwater piping owned by the Township that runs beneath the property located at 55-117 Longview Street, West Orange, NJ 07052, known as Block 71.02, Lot 1 (the “Property”); and WHEREAS, the owner of the Property has agreed to a Temporary Easement and Access Agreement, attached herein as Exhibit “A,” to perform the emergency repair at various locations where the stormwater pipes and outfalls are located on the property; and WHEREAS, there are areas of the outfall stormwater piping channel which must be repaired on an emergent basis due to the eroding state of the outfall stormwater piping on the Property, including, but not limited to, one of which runs between units 7 and 8, abutting Randolph Place, and one of which runs on the southerly side of unit 8, also abutting Randolph Place, along with any other area that the parties mutually agree to, as depicted on the survey attached herein as Exhibit “B,”; and WHEREAS, the Township Engineer has deemed these repairs necessary to protect the health and safety of residents located on Randolph Place; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Township Council of the Township of West Orange, that Township is authorized to enter into the Temporary Easement and Access Agreement attached herein as Exhibit “A;”;and be it further RESOLVED, that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law.
