All members present voting “Aye.” BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey as follows: Section 1, Subsections 7-32.2, Restricted Parking Zones of the Revised General Ordinances of the Township of West Orange is hereby supplemented and amended as follows (italic type denotes deletion, bold type denotes addition): 7-32.2 Restricted Parking Zones. Pursuant to N.J.S.A 39:4-197,6, Restricted Parking Zones, as defined in N.J,S.A, 39:4-207.6¢, are established in front of the following residences as indicated on the Tax Maps of the Township of West Orange, at the specified locations. Parking within a specific zone is restricted to the motor vehicle issued a permit pursuant to N.J.S.A. 39;4-197,7, In accordance with N.J.S.A., 39:4-197.6 parking is permitted in the Restricted Parking Zone except when prohibited in front of the residence by other sections of this Chapter. Subsection 7-23.1, Turn Prohibitions, of the Revised General Ordinances of the Township of West Orange is hereby supplemented and amended as follows: (italic type denotes deletion, bold type denotes addition): Intersection Turn Hours/ Movement Prohibited Prohibited Days Glenview Drive and Left All Southbound on Glenview Drive Northfield Avenue to Eastbound on Northfield Avenue Section 2. If any provisions of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any of the provisions or applications of this Ordinance that can be given effect without the valid provision(s) or application and to this end, the provisions of this Ordinance are severable. Section 3. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 4. This Ordinance shall take effect upon final passage and publication in accordance with law and approved by the County of Essex, Board of Chosen Freeholders. Section 7. Unless another penalty is expressly provided by New Jersey Statute, every person. convicted of a violation of any provision of this Ordinance or any supplement thereto shall be liable to the penalty of not more than fifty dollars ($50.00) or imprisonment for a term not to exceed fifteen (15) days or both, as per W.O.R.G.O, Chapter 7-4.2 The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. Councilwoman Ghebremicael, Councilwoman Rudin, Councilwoman Scarpa and Council President Krakoviak voting “Aye.” Councilwoman Casalino voting “Nay.” BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY, that Chapter 28 of the Revised General Ordinances of the Township of West Orange be and is hereby amended as follows: 1 PURPOSE ‘This purpose of this Ordinance is to limit the use of gas-powered leaf blowers seasonally within the Township of West Orange and then fully by January I, 2026, and to promote a transition to the exclusive use of electric and battery-operated blowers on all properties within the Township whether privately or Township-owned. ARTICLE II: USAGE OF LEAF BLOWERS WITHIN THE TOWNSHIP OF WEST ORANGE § 28-12—DEFINITIONS Air Quality Action Day: An air quality action day is called when the ozone and/or particulate matter forecasts reach an Air Quality Index (AQT) of orange (unhealthy for sensitive groups), red (unhealthy), or maroon (very unhealthy). Electric-Powered Leaf Blower: A device powered by a battery or plug-in electricity, used in yard maintenance. Gas-Powered Leaf Blower: A device powered by a two or four stroke engine using gasoline or a gasoline-oil mixture, primarily used for blowing grass clippings, debris,

@ = Third Violation: $500 fine issued to both homeowner and landscaping company After three violations by the same landscaping company, that company shall be suspended from working in West Orange for one year. Hach violation shall be considered a separate offense. § 28-16—LAWN CARE REGISTRY To ensure compliance with this ordinance, all lawn care businesses operating within the Township must be registered with the Township. A list of authorized businesses will be posted on the Township’s website. This registry will be formalized by resolution. I. SEVERABILITY If any part of this Ordinance is found to be invalid, the judgment will apply only to that specific section, paragraph, subparagraph, clause, or provision, and the remainder of the Ordinance will remain valid and in effect. TH, REPEAL OF CONFLICTING ORDINANCES All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed. Iv. EFFECTIVE DATE This Ordinance shall take effect upon final passage and publication, as provided by law. Special event security/crowd control assignments are defined as assignments not worked. on a regular/steady basis. 4, Traffic/Road Construction. Assignments for all traffic control at construction site assignments shall be as follows: (a) Assignments between 12:00 a.m. on Monday and 11:59 p.m, on Friday shall be paid at a rate as prescribed by Resolution. This rate includes an administrative fee prescribed by the same Resolution, (b) Assignments between 12:00 a.m. on Saturday and 11:59 p.m. on Sunday shall be paid at a rate as prescribed by Resolution. This rate includes an administrative fee prescribed by the same Resolution. {c) All road construction assignments that require the use of a marked patrol unit shall be charged additionally, as prescribed by Resolution. This is in addition to the administrative fees already billed. The assignment of the vehicle will be determined by the Police Administration and availability of the vehicles at the time of the request. {d) All emergency road work assignments which are received by the Township on less than 24 hours’ notice shall require a separate fee paid at a rate as prescribed by Resolution. This rate includes an administrative fee prescribed by the same Resolution. b. All assignments shall have a four-hour minimum per officer contracted, ce. Officers are entitled to the minimum hours of compensation stipulated in subsection 4- 34.3b if their assignment is cancelled upon their arrival at the job site without advance notice stipulated in subsection 4-34,4c, d. Officers who begin an assignment, but who are cancelled prior to the completion of the assignment shall be entitled to the minimum compensation stipulated in subsection 4- 34.3b or the number of hours worked, whichever is longer. iu. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. Tv. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance. Vv. EFFECTIVE DATE This Ordinance shall take effect upon final passage and publication in accordance with the law. All members present voting “Aye.” BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapter 10, Section 2 et seg. and Section 11 et seq. of the Revised General Ordinances of the Township of West Orange be and are hereby amended and supplemented as follows: 21

the Municipal Judge; or any dog which, for good cause shown at the hearing pursuant to subsection § 10-6.2, is declared to be vicious by the Judge of the Municipal Court. § 10-2.2. Application for License. Each application for a license under this chapter shall provide the following information: a. A general description of the dog sought to be licensed, including name, breed, sex, age, color i and markings, and whether such dog is altered with documentation indicating that such dog is i spayed and/or neutered, and whether such dog is of a long or short haired variety. b. Name, street and post office address of the owner or keeper of such dog. ! ¢. Telephone number and e-mail address of the owner or keeper of such dog. d. Evidence of inoculation with rabies vaccine showing a validation date effective through October 31st of the current year or certificate of exemption. The owner or keeper shall provide evidence that the dog to be licensed and registered has been inoculated with a rabies vaccine of a type approved by and administered in accordance with the recommendations of the United States Department of Human Services or has been certified exempt. The rabies inoculation shall be administered by a duly licensed veterinarian, or by such other veterinarian permitted by law to do the same. I i I i Registration numbers shall be issued in the order in which applications are received. § 10-2.3. Application for License and Renewal, When Made. The application for a license shall be made within 10 days of the day upon which the dog first becomes subject to the provisions of this section. Applications for license renewal and registration tags for dogs which are required to be licensed by the provisions of subsection § 10- 2.1 shall be made before February 1 of each calendar year. § 10-2.4. License Record. i The information on all applications under this chapter and the registration number issued to each licensed dog shall be preserved for a period of three years by the Health Department. In addition, it shall forward similar information to the State Department of Health each month on forms furnished by the Department, §10-2.5, Fees, The following fees are applicable to dog license and dog registration fee applications: a, The person applying for a license shall pay a fee in an amount prescribed by Resolution. These same fees shall apply and be charged

In addition, a late fee in an amount prescribed by Resolution will be charged to any person who | submits an application on or after March 1 of any calendar year for a renewal of a license for a i dog required to be licensed under subsection § 10-2.1a. Such fee shall be charged to cach late application submitted. c, The fee for a potentially dangerous dog license shall be set forth by Resolution in accordance with N.LS.A. 4:19-31. § 10-2.6. Requirements for Veterinarians and Home Owners a, All property owners shall be required to ensure that all tenants and/or other occupants in their residence with a dog have a valid, up to date dog license from the Township of West Orange. 23
