BOND ORDINANCE 2367-12 BOND ORDINANCE AMENDING VARIOUS BOND ORDINANCES TO AMEND THE DESCRIPTION TO PROVIDE FOR VARIOUS CAPITAL IMPROVEMENTS FOR AND BY THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, COUNTY OF ESSEX, NEW JERSEY (not less than two-thirds of all the members thereof affirmatively concurring), AS FOLLOWS: SECTION ONE: The Township Council of the Township of West Orange, in the County of Essex, New Jersey, has ascertained and determined to amend the Bond Ordinances set forth below, as follows: BOND ORDINANCE 1374-96 “SECTION 1: The Bond Ordinance of the Township Council of the Township of West Orange, in the County of Essex, New Jersey (the “Township”) entitled “BOND ORDINANCEAUTHORIZING THE FUNDING OF OBLIGATIONS OF THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY, UNDER REGIONAL CONTRIBUTION AGREEMENTS PURSUANT TO N.J.S.A. 52:27D-301 et seq., APPROPRIATING $1,395,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,325,250 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF”, finally adopted on February 6, 1996 (the “Ordinance”) is hereby incorporated by reference in its entirety. SECTION 2: Section 1 of the Ordinance is hereby amended by (a) adding in Section 1 of the Ordinance after the phrase “under regional contribution agreements entered into pursuant to N.J.S.A. 52:27D-301 et seq.” the following additional project “and Various Road Improvements, including but not limited to Nicholas Avenue and Mountain Avenue, and improvements to outdoor facilities, and including all work or materials necessary therefor or incidental thereto,” and (b) deleting the reference of 5 years for the useful life in Section 6(b) of the Ordinance and substituting in lieu therefor 9.27 years. #1872460 v1 100181-33129

SECTION 3: The capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolutions in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection. SECTION 4: All other provisions of the Ordinance shall remain unchanged. SECTION 5: This amendatory bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption as provided by Local Bond Law.” BOND ORDINANCE 1760-01 “SECTION 1: The Bond Ordinance of the Township Council of the Township of West Orange, in the County of Essex, New Jersey (the “Township”) entitled “BOND ORDINANCE AUTHORIZING VARIOUS CAPITAL IMPROVEMENTS IN AND FOR THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY APPROPRIATING $1,301,000 THEREFORE AN AUTHORIZING THE ISSUANCE OF $1,235,950 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF”, finally adopted on April 10, 2001, as amended (the “Ordinance”) is hereby incorporated by reference in its entirety. SECTION 2: Section 3(a)(3)(b) of the Ordinance is hereby amended by (a) adding at the end thereof the additional project “and Various Road Improvements, including but not limited to Nicholas Avenue and Mountain Avenue, and improvements to outdoor facilities, and including all work or materials necessary therefor or incidental thereto”; (b) by deleting the reference of 15 years in said section for the useful life and substituting in lieu therefor 10.02; and by (c) deleting the reference of 12.06 years for the useful life in Section 6(b) of the Ordinance and substituting in lieu therefor 11.82 years. SECTION 3: The capital budget of the Township is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolutions in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection.
