332-24 November 25, 2024 RESOLUTION AUTHORIZING THE COLLECTOR OF TAXES TO REFUND PAYMENT TO THE LISTED TAXPAYER DUE TO A DUPLICATE PAYMENT OF TAX/AND OR SEWER CHARGE WHEREAS, certain West Orange property owners or their mortgage company have made a duplicate payment for the 2024 third quarter taxes WHEREAS, the Tax Collector of the Township of West Orange has indicated that such Taxpayers or their mortgage company are entitled to refunds to the extent of such overpayments; NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Orange that the Tax Collector and the Treasurer of the Township of West Orange be and they are hereby authorized, empowered and directed to cause to be paid to the taxpayers on the attached list sums in full and final satisfaction of the overpayment of these charges. 333-24 November 25, 2024 RESOLUTION AUTHORIZING THE COLLECTOR OF TAXES TO REFUND PAYMENT TO THE LISTED TAXPAYER DUE TO VETERAN EXEMPTION WHEREAS, the Assessor has granted a 100% Veteran Disabled exemption to parcels listed below and a letter of eligibility from the Veteran’s Administration is on file in the Assessor’s office showing the effective date of exemption. WHEREAS, the owner or its mortgage servicer made payments after the date of exemption and tax refunds are due in the amounts listed below. 334-24 November 25, 2024 RESOLUTION TO HOLD A CLOSED SESSION WHEREAS, the Open Public Meetings Act (N.J.S.A. 10:4. et seq.) provides for the exclusion of the public meetings of the governing body during the discussion of certain matters; and WHEREAS, prior to the exclusion of the public from a meeting of the Township Council it is required that the Council adopt a Resolution stating the general nature of the subject to be discussed and stating as precisely as possible the time when the minutes of the discussion conducted in closed session can be disclosed to the public; and WHEREAS, this body is about to consider a matter which falls within the purview of N.J.S.A. 10-4-12, and can properly exclude the public from such discussions; now, therefore, be it BE IT RESOLVED, that the Township Council of the Township of West Orange, now assembled in public session at its regular meeting of November 25, 2024 enter into a closed session to consider the following matter(s). () 1. Discussion of any material, the disclosure of which constitutes an invasion of individual privacy. ( X) 2. A collective bargaining agreement or the terms of provisions of same. () 3. Techniques or tactic utilized to protect the safety and property of the public provided that their disclosure could impair such protection. () 4. An investigation of violations or possible violations of the laws of the State of New Jersey and/or the Township of West Orange Administrative Code. (X) 5. Pending or anticipated litigation or contract negotiation in which this body is or maybe a party. () 6. A matter falling within the attorney-client privilege to the extent that confidentiality is required in order for the attorney to exercise his ethical duties to this body. (X) 7. Personnel matters. () 8. Discussion of any matter which by express provision of Federal law or State statute or rule of Court shall be rendered confidential. () 9. Discussion of any matter in which the release of information would impair a right to receive funds from the Government of the United Sates. () 10. Discussion of any matter involving the purchase, lease or acquisition of real property with public funds, the setting of banking rates or investment of public funds, where it could adversely affect the public interest if discussion of such matters were disclosed.

() 11. Deliberations occurring after a public hearing that may result in imposition of a civil penalty or suspension or loss of a license or permit. More specifically, the Council may discuss in closed session the following topic(s):     Union Contracts Ordinance 2881-24 (Severance Liabilities) Director Appointments. Pop Up Parties and Zoning (the general subject matter(s) of discussion shall be indicated by a check mark in the appropriate box and shall be more specifically referred to thereafter to the extent such additional disclosure can be made without compromising the need for confidentiality giving rise to the closed session. IT IS FURTHER RESOLVED that the minutes of said discussion shall be made public as soon as the matter under discussion is no longer of a confidential or sensitive nature such that the public interest will no longer be served by such confidentiality. 336-24 November 25, 2024 R E S O L U T I O N WHEREAS, on October 30th, 2024, the DPW Director Louis Reynolds inspected the stairs and railing at Stagg Field and it was concluded that these were in disrepair; and WHEREAS, the Municipal Engineer proceeded to contract Grabowski Construction., Inc. to conduct the necessary repairs to the stairs and railing; and WHEREAS, pursuant to the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11.6a the Municipal Engineer on November 6th, 2024 notified the Administration and Purchasing Agent of the need to perform an emergency contract for this work; and WHEREAS, it was concluded that to expedite this work to protect public health and safety, an emergency contract was issued to Grabowski Construction., Inc. who was readily available to mobilize and perform the work; and WHEREAS, the Municipal Engineer by letter dated November 20, 2024 recommends paying the costs of this emergency work; and WHEREAS, Grabowski Construction., Inc submitted invoice dated November 20th, 2024 for the emergency repair for the stairs and railing in the amount of $11,647.00; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in the amount not to exceed $11,647.00 is authorized to Grabowski Construction., Inc. for emergency at Stagg Field to repair the stairs and railing. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to

2870-24 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 25, SECTION 29 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE BASED ON RECOMMENDATIONS OF THE NEW JERSEY STORMWATER BEST MANAGEMENT PRACTICES MANUAL BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapter 25, Section 29 et seq., requires amendments based on the recommendations from the New Jersey Stormwater Management Practices Manual as follows: § 25-29.1—Scope and Purpose: A. Policy Statement Flood control, groundwater recharge, and pollutant reduction shall be achieved through the use of stormwater management measures, including green infrastructure Best Management Practices (GI BMPs) and nonstructural stormwater management strategies. GI BMPs and low impact development (LID) should be utilized to meet the goal of maintaining natural hydrology to reduce stormwater runoff volume, reduce erosion, encourage infiltration and groundwater recharge, and reduce pollution. GI BMPs and LID should be developed based upon physical site conditions and the origin, nature and the anticipated quantity, or amount, of potential pollutants. Multiple stormwater management BMPs may be necessary to achieve the established performance standards for water quality, quantity, and groundwater recharge. B. Purpose The purpose of this ordinance is to establish minimum stormwater management requirements and controls for “major development,” as defined below in § 25-29.2. C. Applicability 1. This ordinance shall be applicable to the following major developments: a. Non-residential major developments; and b. Aspects of residential major developments that are not pre-empted by the Residential Site Improvement Standards at N.J.A.C. 5:21. 2. This ordinance shall also be applicable to all major developments undertaken by Township of West Orange. 3. An application required by ordinance pursuant to C.1 above that has been submitted prior to the adoption of this Ordinance, shall be subject to the stormwater management requirements in effect on one (1) day prior to the adoption date of this ordinance. 1 Deleted: Section II
