361-24 December 10, 2024 RESOLUTION WHEREAS, Chapter 25, Section 24.7 of Municipal Code of the Township of West Orange (the “Township”) sets forth the requirements for obtaining a film permit for the filming of television or motion pictures within the Township; and WHEREAS, the fees for obtaining a film permit under the application provisions of the Municipal Code provide that the fees shall be set by Resolution adopted by the Township Council; and WHEREAS, the New Jersey Motion Picture and Television Development Commission has provided a model fee schedule as part of the statewide “NJ Film Ready Community” program identifying municipalities within the State of New Jersey welcoming of the filming of movies and television; and WHEREAS, the Township seeks to establish the permit fee schedule for the issuance of a film permit for the filming of television and motion pictures within the Township as follows: 1. Basic filming permit: $100. Where an applicant requests a waiver of the provision of Chapter 25, Section 24.7, Subsection d(8) of the Township Municipal Code requiring expedited processing of a permit application within seven (7) days of the filming date, the basic filming permit fee for processing the application on an expedited basis shall be $200. 2. Daily filming fee payable in addition to the basic filming permit when filming entirely on public property: $150 per day. 3. Daily filming fee payable for major motion picture when filming entirely on public property: $500 per day.
4. Filming permit for nonprofit applicants filming for educational purposes, including student films (no daily rate required): $25. 5. Filming on private property: no daily filming fee will be imposed. (the “Proposed Film Permit Fee Schedule”); and WHEREAS, the Township seeks to maintain this Proposed Film Permit Fee Schedule until such time as a new film permit fee schedule is established by resolution of the Township Council. NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Township hereby sets the permits fees required for the issuance of a film permit from the Township consistent with the Film Permit Fee Schedule described herein; and it is further RESOLVED that the Film Permit Fee Schedule shall remain in place until such time as the film permit fee schedule is amended or changed by further resolution of the Township Council. 362-24 December 10, 2024 TOWNSHIP OF WEST ORANGE ESSEX COUNTY, NEW JERSEY ADOPTING MEMORANDUM OF AGREEMENT BETWEEN THE TOWNSHIP OF WEST ORANGE AND AFSCME NEW JERSEY COUNCIL 63, LOCAL 3476 WHEREAS, the Township of West Orange (“Township”) is the employer of the employees in the collective negotiations unit represented by the AFSCME New Jersey Council 63, Local 3476 (“AFSCME”); and WHEREAS, the Township and AFSCME negotiation committees have been involved in negotiations for a successor collective bargaining agreement, which expired on December 31, 2023; and WHEREAS, the Township’s negotiating committee has entered into a Memorandum of Agreement (“MOA”) with AFSCME which amends the terms and conditions of the collective negotiations agreement to cover an effective term of January 1, 2024 through December 31, 2029; WHEREAS, it is the desire of the Township to memorialize these terms and to approve the attached Memorandum of Agreement modifying the current collective bargaining agreement. NOW, THEREFORE, BE IT RESOLVED, 1. The Township hereby approves the MOA by and between the Township and AFSCME; and 2. The Township’s Business Administrator is authorized and directed to make all necessary changes and revisions to the collective bargaining agreement in order to reflect the terms and conditions agreed upon in the MOA, and further authorized to execute the collective bargaining agreement on behalf of the Township once revised. 362-24 MEMORANDUM OF AGREEMENT BETWEEN TOWNSHIP OF WEST ORANGE AND AFSCME NEW JERSEY COUNCIL 63, LOCAL 3476 (“AFSCME”) The TOWNSHIP OF WEST ORANGE (“TOWNSHIP”) and AFSCME NEW JERSEY COUNCIL 63, LOCAL 3476 (“AFSCME”) hereby agree to recommend for ratification and approval the following for a new contract between the TOWNSHIP and AFSCME for the period from January 1, 2024 to December 31, 2029: 1. DURATION: January 1, 2024 to December 31, 2029. 2. ARTICLE XVII, Wages: January 1,2024— 1.5%; July 1, 2024 - 1.5%, January 1, 2025 - 3%; January 1, 2026 - 3%; January 1, 2027 — 3%; January 1,2028- 3%; and January 1,2029- 3%. Amend to provide that the Township shall be able to move toa bi-monthly or semi-monthly payroll at its discretion. 3. ARTICLE IL, Grievance Procedure: a. Revise Step Three to provide for a hearing within 15 calendar days instead of 10 working days and a decision from the hearing in 10 calendar days instead of 7 working days, b. Revise Step Four: “{n the event that the Union is not satisfied with the decision at Step Three, no hearing is held within 15 calendar days, or no decision has been rendered within 10 calendar days...” c. Add new Section G. — The above Grievance Procedure may be modified or relaxed either permanently or on a case-by-case basis if the parties agree to do so in writing. 4. ARTICLES IV/XXX: Merge both Articles Union Business and Workplace Democracy Act into a single Article and renumerate Agreement Articles as applicable.

ARTICLE XX], Sick Leave: Amend the Article to add the following: “Employees who are out on leave shall not accrue any additional leave time until they return to work.” The terms of this MOA are subject to ratification by. AFSCME and the approval of the Council of the TOWNSHIP OF WEST ORANGE. All prior agreements and all other provisions of the Parties’ existing collective bargaining agreement hot modified by this MOA shall remain in effect and otherwise unchanged. All issues not included in this MOA shall be considered withdrawn. 363-24 December 10, 2024 RESOULTION APPROVING MEMORANDUM OF AGREEMENT BETWEEN WEST ORANGE PBA LOCAL 25 AND THE TOWNSHIP OF WEST ORANGE WHEREAS, the Township of West Orange (“Township”) and West Orange PBA Local 25 (“PBA”), have an existing Collective Bargaining Agreement; and WHEREAS, the existing Collective Bargaining Agreement expired on December 31, 2023; and WHEREAS, the township and PBA have negotiated in good faith; and WHEREAS, on or about December 4, 2024, the Township and PBA entered into a Memorandum of Agreement containing the terms for a new Collective Bargaining Agreement for the Period of January 1, 2024 through December 31, 2028; and WHEREAS, James P. Abbott, Interim Business Administrator, executed the Memorandum of Agreement subject to the Township Council’s consideration and approval; and WHEREAS, upon formal approval, it is anticipated that a formal Collective Bargaining Agreement will be drafted and executed between the parties; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Memorandum of Agreement dated December 4, 2024 between PBA and the Township of West Orange, annexed hereto as Exhibit “A,” be and is hereby approved, and be it further RESOLVED, that the Township Clerk shall make available during normal business hours the annexed Memorandum of Agreement subject to the terms and conditions set forth in a formal agreement. 2024-2028 MEMORANDUM OF AGREEMENT BY AND BETWEEN THE TOWNSHIP OF WEST ORANGE AND WEST ORANGE PBA LOCAL #25 WHEREAS, the Township of West Orange (Township) and the West Orange PBA Local #25 (PBA) are parties to a series of successive collective negotiations agreements (CNAs), the most recent of which covered the period of January 1, 2018 through December 31, 2022 as well as a one (1) year extension through December 31, 2023; WHEREAS, the parties have engaged in good faith negotiations re the terms of a successor collective negotiations agreement for the years 2024 through 2028; WHEREAS, the parties have agreed upon the terms and conditions set forth below, subject to the ratification by the PBA’s membership as well as the Township’s Governing Body; WHEREAS, all terms set forth below shall be retroactive to January 1, 2024 unless otherwise stipulated below. Moreover, again unless otherwise stipulated below, the terms set forth herein shall apply to any member who retired on or after January 1, 2024 and prior to the ratification of this Agreement by both parties. Lastly, all terms set forth in the parties’ 2018 - 2022 CNA and one (1) year extension for 2023 shall be retained, unchanged, in the successor agreement unless otherwise stipulated below. NOW, THEREFORE BE IT RESOLVED, the parties tentatively agree as follows: DURATION. Five (5) years: January 1,2024 through December 31, 2028. ARTICLE V - RETIREMENT (pg. 6). The current text shall be replaced with the following: “Consistent with the provisions of Article XXI, Paragraph G, with respect to those members employed prior to February 15, 2022 as well as thase who retired prior February 15, 2022, the Township shall pay 100% of the premiums for Medical and Prescription benefits upon Retirement for Retirees, Spouse and Eligible Dependents for life, the premiums for said benefits to be paid 100% by the Township. Members hired after February 15, 2022 shall not be eligible for Township paid medical and prescription benefits in retirement. Rather, as per Article XX|, Paragraph G, the Township shall contribute 10.5% of those members’ gross salary (defined as base salary, holiday pay, longevity pay, detective stipend and stipends set forth in Article XX herein combined) every pay period throughout the year for the duration of those members’ employment with the Township, into a tax deferred compensation plan

Notwithstanding any of the above, if an active member dies, regardless of date of hire, or is awarded a PFRS accidental disability pension for actions taken on duty or while performing police duties of duty, the Township shall pay 100% of the Health and Prescription benefits premiums for the member and the surviving spouse for his/her life and eligible dependents. Moreover, all other existing retirement rights set forth in current Township Ordinance shall not be unilaterally reduced or modified by the Township.” ARTICLE VII - WORK WEEK OVERTIME (pg. 8). Section 3. Effective January 1, 2025, the annual stipends for Line Detectives and Administrative Detectives shall be increased by $500 to $2,500 and $1,500, respectively. The parties’ settlement re the PBA’s On-Call compensation grievance (NJSBM Case No. 21-0062} dated October 3, 2022 shall be incorporated herein, replacing the existing text reference to 4 hours On-Call time off for each 24 hour period with the following: “1, Effective January 1, 2022, each on-call assignment shall be deemed to have excluded not only those hours the on-call Detectives and Detective Supervisors worked his/her regular tour of duty but also those hours other CID personnel worked their regular tour of duty. For example, if the on-call Detective and or Detective Supervisor worked his/her regular tour of duty from 8am ~4pm and other CID personnel worked their regular tour of duty from 4pm ~ Midnight, then the Detective and/or Detective Supervisor was on-call for eight (8) hours (Midnight to 8am) and is entitled to one (1) hour at the rate of time and one-half (1 4) -- or one and one-half (14) hours total — in cash or compensatory time at his/her option. Again, if the on-call Detective and or Detective Supervisor utilized paid leave other than sick leave and did not work his/her regular tour of duty, then he/she shall have remained on-call for those hours that no other CID personnel worked their regular tour of duty. 2. Effective October 3, 2022 each on-call assignment shall be eight (8) hours in duration as pera weekly schedule posted by the Chief or his designee. Said schedule shall be posted at least three (3) weeks in advance. The PBA and SOA recognize the Township’s managerial prerogative to include one or both of Detectives and/or Detective Supervisors for a given on-call assignment when setting the schedule, 3. In the
