343-24 December 20, 2024 STATE OF NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES PROGRAM ENABLING RESOLUTION for SUPPLEMENTAL FUNDING REQUEST WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and WHEREAS, the Township of West Orange has previously obtained a Green Acres loan of $0.00 and/or a Green Acres grant of $4,500,000.00 from the State [and an Urban Parks grant of $0.00 from the State] to fund the following project(s): #0722-03-005- West Orange Township Open Space Acquisition (Rock Spring Golf Course); and WHEREAS, the Township of West Orange desires to further the public interest by requesting an additional Green Acres loan of $0.00 and/or an additional Green Acres grant of $5,250,000.00 to fund the project(s); and WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and WHEREAS, the applicant is willing to use the State’s funds in accordance with its rules, regulations and applicable statutes, and is willing to enter into an Amendment of the Agreement with the State for the above-named project; NOW, THEREFORE, the governing body/board resolves that: 1. Susan McCartney or the successor to the office of Mayor is hereby authorized to: (a) request such a loan and/or such a grant, (b) provide additional information and furnish such documents as may be required, and (c) act as the authorized correspondent of the above-named applicant; and 2. The applicant agrees to provide the local government/nonprofit share if a match is required. 3. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project. 4. This resolution shall take effect immediately. Karen J. 361-24 December 20, 2024 RESOLUTION WHEREAS, Chapter 25, Section 24.7 of Municipal Code of the Township of West Orange (the “Township”) sets forth the requirements for obtaining a film permit for the filming of television or motion pictures within the Township; and WHEREAS, the fees for obtaining a film permit under the application provisions of the Municipal Code provide that the fees shall be set by Resolution adopted by the Township Council; and WHEREAS, the New Jersey Motion Picture and Television Development Commission has provided a model fee schedule as part of the statewide “NJ Film Ready Community” program identifying municipalities within the State of New Jersey welcoming of the filming of movies and television; and WHEREAS, the Township seeks to establish the permit fee schedule for the issuance of a film permit for the filming of television and motion pictures within the Township as follows: 1. Basic filming permit: $150. Where an applicant requests a waiver of the provision of Chapter 25, Section 24.7, Subsection d(8) of the Township Municipal Code requiring expedited processing of a permit application within seven (7) days of the filming date, the basic filming permit fee for processing the application on an expedited basis shall be doubled. 2. Daily filming fee payable in addition to the basic filming permit when filming entirely on public property: $500 per day. Where an applicant requests a waiver of the provision of Chapter 25, Section 24.7, Subsection d(8) of the Township Municipal Code requiring expedited processing of a permit application within seven

4845-9559-2678, v. 1 (7) days of the filming date, the daily filming fee for processing the application on an expedited basis shall be doubled. 3. Daily filming fee payable for major motion picture when filming entirely on public property: $1,500 per day. Where an applicant requests a waiver of the provision of Chapter 25, Section 24.7, Subsection d(8) of the Township Municipal Code requiring expedited processing of a permit application within seven (7) days of the filming date, the basic filming permit fee for processing the application on an expedited basis shall be doubled 4. Filming permit for nonprofit applicants filming for educational purposes, including student films (no daily rate required): $25. 5. Filming on private property: no daily filming fee will be imposed. (the “Proposed Film Permit Fee Schedule”); and WHEREAS, the Township seeks to maintain this Proposed Film Permit Fee Schedule until such time as a new film permit fee schedule is established by resolution of the Township Council. NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Township hereby sets the permits fees required for the issuance of a film permit from the Township consistent with the Film Permit Fee Schedule described herein; and it is further

Ordinance xxxx-24 BE IT ORDAINED by the Township Council of the Township of West Orange as follows: SECTION 1. All terms and conditions included in any authorized collective bargaining agreements and/or employment contracts or other agreements impacting employment terms and conditions are hereby included in SECTION 1 above. SECTION 4. Part time employees have no annual increment for their hourly rate in Section 1 above. SECTION 5. This ordinance and the titles and salary ranges herein provided shall become effective on the dates specified and as indicated above in SECTION 1. Where the specified timeframes have expired, the salary range specified in the latest timeframe will remain in effect until a new range is adopted by Ordinance. SECTION 8. All ordinances and parts of ordinances heretofore enacted which are inconsistent with any provision of this ordinance are, to the extent of such inconsistency, hereby repealed. SECTION 9. Carnevale, Municipal, Clerk AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE'S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL. SECTION 3. All part time employee hourly rates are determined by dividing the Minimum and Maximum rates by the # of annual hours a full time employee would work for that position using the salaries identified in Section 1 above. SECTION 6. Effective as of the date of adoption of this salary ordinance, the Mayor, or his/her designee, is hereby authorized to enter into acknowledgement agreements with employees identifying, specifying and memorializing the limitations of both pre and post-retirement benefits provided by the Township. Specifically included, but not limited to, is the provision of fully paid post-employment family health benefits to employees upon retirement that shall be strictly limited to employees hired prior to January 1, 2021. This section shall not impact employees covered under a separate Collective Bargaining Agreement. As part of entering into such acknowledgement agreements, a master list of all active employees, retiree or their surviving spouses eligible to receive limited post-employment health benefits shall be maintained. SECTION 7. In order to maintain a competitive workforce and provide social equity in the workplace, the Council endorses the Administration's intention to award step credits to new and existing non-uniformed employees for recognized or previously unrecognized educational accomplishments, bi-lingual capabilities, state certifications, promotions, performance, work experience, and other criteria established by the Administration including social equity credits for an employee's household dependent minors, as an example.
