61-25 January 28, 2025 RESOLUTION AUTHORIZING THE COLLECTOR OF TAXES TO REFUND PAYMENT TO THE LISTED TAXPAYER DUE TO A DUPLICATE PAYMENT OF TAX AND/OR SEWER CHARGE WHEREAS, certain West Orange property owners or their mortgage company have made a duplicate/overpayment the sewer payment WHEREAS, the Tax Collector of the Township of West Orange has indicated that such Taxpayers or their mortgage company are entitled to refunds to the extent of such overpayments; NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Orange that the Tax Collector and the Treasurer of the Township of West Orange be and they are hereby authorized, empowered and directed to cause to be paid to the taxpayers on the attached list sums in full and final satisfaction of the overpayment of these charges. 63-25 January 28, 2025 RESOLUTION WHEREAS, the Township of West Orange is a Faulkner Act Mayor-Council form of government with a Law Department established by Ordinance, the Director of which is the Township Attorney; and WHEREAS, pursuant to N.J.S.A. 40:69A-43 and Township Ordinance Section 2-9.1 the Mayor shall appoint a Township Attorney to serve during the term of office for the Mayor appointing the Township Attorney subject to the Council’s advice and consent; and WHEREAS, on or about November 12, 2024, the Township advertised a request for proposal for the position of Township Attorney and Assistant Township Attorney; and WHEREAS, on December 3, 2024, the Township received various responses which included resumes; and WHEREAS, the Mayor and senior administration officials interviewed the candidates for the position of Township Attorney; and WHEREAS, on December 31, 2024, the Mayor submitted three (3) names to the Township Council for consideration for approval as Township Attorney; and WHEREAS, on January 6, 2025, Township Attorney Richard D. Trenk, Esq. of Trenk Isabel Siddiqi & Shahdanian P.C. submitted his retirement subject to the appointment of a new Township Attorney and a reasonable transition in the best interests of the Township; and WHEREAS, the Mayor and senior administration have offered to coordinate and organize interviews of the Mayor’s three (3) recommendations for the position of Township Attorney; and WHEREAS, the Mayor submits Edward J. Florio, Esq. of Florio Kenny Raval LLP to serve as the new Township Attorney based upon his substantial experience and knowledge of

municipal law; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Mayor’s appointment of Edward J. Florio, Esq. of Florio Kenny Raval LLP as the new Township Attorney be and is hereby approved in accordance with the Township Council’s advice and consent role. 66-25 January 28, 2025 Formatted: Right RESOLUTION WHEREAS, the law firm of Bourne, Noll & Kenyon, principally Ed Matthews, Esq., has provided professional services to the Township of West Orange in connection with residential real estate tax appeals since January 2013; and WHEREAS, Bourne, Noll & Kenyon provided responses to the Township’s Request for Qualifications pursuant to a fair and open process for the year 2025; and WHEREAS, Bourne, Noll & Kenyon has agreed to provide professional services for the calendar year 2025, pursuant to the terms and conditions set forth in the agreement annexed hereto as Exhibit “A;” and WHEREAS, the Law Department recommends retention of Bourne, Noll & Kenyon as special counsel to the Township for the purpose of representing the Township in residential real estate tax appeals; and WHEREAS, pursuant to pursuant to N.J.S.A. 40A:11-5(1)(a)(i), the proposed professional services contract is subject to an exception to the standard bidding procedures set forth in the Local Public Contracts Law; NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Mayor be and is hereby authorized to execute an agreement, in the form annexed hereto, to retain Bourne, Noll & Kenyon for the provision of residential real estate tax Deleted: commercial appeal services in accordance with Exhibit “A” and the Municipal Clerk shall be and hereby is Deleted: on a flat fee basis of $3,250 per month authorized to attest to the Mayor’s signature; and it is further
