2894-25 AN ORDINANCE AMENDING CHAPTER 2, SECTION 9.4 GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (SPECIAL COUNSEL) BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapter 2, Sections 9.4 of the Revised General Ordinances of the Township of West Orange be and are hereby amended as follows: I. PURPOSE The purpose of this ordinance is to modify the provisions of the Township of West Orange Municipal Code governing the Township’s retention of Special Counsel. This ordinance: (i) requires appointment of Special Counsel by advice and consent of the Township Council; and (ii) require that the bills for Special Counsel shall be subject to approval from the Township Council. II. CHAPTER 2 SECTIONS 9.4 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 2-9.4 Special Counsel. Subject to the advice and consent of the Governing Body, the Township Attorney may appoint such Special Counsel as may be required or advisable to handle matters in which a conflict of interest precludes representation by the Township Attorney or Assistant Township Attorney, or which due to its complexity, special nature, time demands or constraints, or for any good reason would benefit from the special experience and/or training of the Special Counsel to be hired. Such Special Counsel need not serve full time and would be expected to serve for the duration of the matter for which he or she was appointed, subject to annual reappointment with the manner and amount of compensation to be approved by the Governing Body. Special Counsel would be subject to the supervision of the Township Attorney. The bills of all Special Counsel shall be subject to approval by the Governing Body. III. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. IV. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance.

755-25 January 28, 2025 RESOLUTION WHEREAS, Mountain Society, LLC, West Orange, NJ 07052 is the holder of Plenary Retail Distribution License No. 0722-44-027-005; and WHEREAS, Wine Valley Outlet, LLC has made an application for a Person-to-Person Transfer for the above-mentioned license; and WHEREAS, the principal has been investigated by the Township Police Department with no impediments to an interest in an alcoholic beverage license; and WHEREAS, due notice of the proposed transfer was published in the West Orange Chronicle on October 31, 2024 and November 7, 2024, appropriate fees have been paid by the applicant, and tax clearance for the transfer has been received; and WHEREAS, a public hearing was conducted on January 28, 2025 and no one appeared in opposition thereto; and WHEREAS, the license will remain in Pocket Status until such time that a location is found by Wine Valley Outlet, LLC, and a Place to Place transfer is approved by the West Orange ABC Board. NOW THEREFORE BE IT RESOLVED that the Township Council of the Township of West Orange hereby authorizes the Person-to-Person Transfer of Plenary Retail Distribution License No. 0722-44-027-005, from Mountain Society, LLC to Wine Valley Outlet, LLC, and is hereby approved. ______________________________________ Karen J. 756-25 January 28, 2025 RESOLUTION WHEREAS, unless otherwise noted herein, the holders of alcoholic beverage licenses from the Township of West Orange set forth on Exhibit A attached hereto and made part hereof, have made applications to this Township of West Orange ABC Board to renew said licenses for the 2024-2025 license term; and WHEREAS, said licenses have paid all license renewal fees and submitted the appropriate application to renew; and WHEREAS, a public hearing was held before the Township of West Orange ABC Board on January 28, 2025 and no one appeared in opposition to any license renewal; and NOW, THEREFORE, BE IT RESOLVED that the Township of West Orange ABC Board wishes to renew the following alcoholic beverage licenses set forth for the 2024-2025 license term: 0722-33-016-006 Tapas Tavern, LLC t/a Secretos Lounge (Inactive) 0722-33-031-007 2001 Proof, LLC (Inactive) KAREN J.
