TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE IN THE COUNTY OF ESSEX, NEW JERSEY PUBLIC NOTICE NOTICE OF PENDING BOND ORDINANCE AND SUMMARY The bond ordinance, the summary terms of which are included herein, was introduced and passed upon first reading at a meeting of the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey (the “Township”) on April 8, 2025. It will be further considered for final passage, after public hearing thereon, at a meeting of the governing body of the Township to be held at the Township Municipal Building, 66 Main Street, West Orange, New Jersey, in said County, on April 22, 2025 at 7:00 p.m. During the week prior to and up to and including the date of such meeting, copies of the full bond ordinance will be available at no cost and during regular business hours at the Clerk’s office for the members of the general public who shall request the same. The summary of the terms of such bond ordinance follows: Title: BOND ORDINANCE PROVIDING FOR VARIOUS 2025 CAPITAL ACQUISITIONS AND IMPROVEMENTS, BY AND IN THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, STATE OF NEW JERSEY, APPROPRIATING $635,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $605,600 BONDS OR NOTES OF THE TOWNSHIP TO FINANCE PART OF THE COST THEREOF Purpose(s): The bond ordinance provides for (i) improvements and repairs to the Lando Parking Lot; (ii) the purchase and installation of calming measures along the entire length or portions of Kelly Drive; and (iii) improvements and repairs along the entire length or portions of Dogwood Drive at Boland Park. Copies of the full bond ordinance are available at no cost and during regular business hours at the Clerk’s office for members of the general public who request the same. CARNEVALE, DO HEREBY CERTIFY that I am the Clerk of the Township of West Orange, in the County of Essex (the “Township”), a municipal corporation organized and existing under the laws of the State of New Jersey, and that as such I am duly authorized to execute and deliver this certificate on behalf of the Township. 2918-25 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 25, SECTION 29 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE BASED ON RECOMMENDATIONS OF THE NEW JERSEY STORMWATER BEST MANAGEMENT PRACTICES MANUAL BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY that Chapter 25, Section 29 et seq., requires amendments based on the recommendations from the New Jersey Stormwater Management Practices Manual as follows: § 25-29.1—Scope and Purpose: A. Policy Statement Flood control, groundwater recharge, and pollutant reduction shall be achieved using stormwater management measures, including green infrastructure Best Management Practices (GI BMPs) and nonstructural stormwater management strategies, and preservation of existing mature trees as per §25-27of the Township Code. GI BMPs and low impact development (LID) should be utilized to meet the goal of maintaining natural hydrology to reduce stormwater runoff volume, reduce erosion, encourage infiltration and groundwater recharge, and reduce pollution. GI BMPs and LID should be developed based upon physical site conditions and the origin, nature and the anticipated quantity, or amount, of potential pollutants. Multiple stormwater management BMPs may be necessary to achieve the established performance standards for water quality, quantity, and groundwater recharge. GI BMPs and LID practices not only address stormwater runoff but may also result in multiple benefits, including providing open space and beautifying neighborhoods, cooling and cleansing the air, reducing asthma and heat-related illnesses, and saving on heating and cooling energy costs. B. Purpose The purpose of this ordinance is to establish minimum stormwater management requirements and controls for “major development,” and “minor development” as defined below in § 25-29.2. C. Applicability: This Ordinance shall be applicable to all zones throughout the Township of West Orange. 1. This ordinance shall be applicable to the following major developments: a. Non-residential major developments; and b. All residential major developments that are not pre-empted by the Residential Site Improvement Standards at N.J.A.C. 5:21. 1 Deleted: XXXX
c. All redevelopment as defined in § 25-29.2 2. This ordinance shall be applicable to minor developments as defined in § 25-29.2. This ordinance shall also be applicable to all major and minor developments undertaken by Township of West Orange, the State of New Jersey or any political subdivision of the state unless specifically exempt by statute, regulations, rule or ordinance. 3. An application required by ordinance pursuant to C.1 above that has been submitted prior to the adoption of this Ordinance, shall be subject to the stormwater management requirements in effect on one (1) day prior to the adoption date of this ordinance. 4. An application required by ordinance for approval pursuant to C.1 above that has been submitted on or after March 2, 2021, but prior to the adoption of this Ordinance, shall be subject to the stormwater management requirements in effect on one (1) day prior to the adoption date of this ordinance. 5. Notwithstanding any rule to the contrary, a major development for any public roadway or railroad project conducted by a public transportation entity that has determined a preferred alternative or reached an equivalent milestone before July 17, 2023, shall be subject to the stormwater management requirements in effect prior to July 17, 2023. D. Compatibility with Other Permit and Ordinance Requirements Development approvals issued pursuant to this ordinance are to be considered an integral part of development approvals and do not relieve the applicant of the responsibility to secure required permits or approvals for activities regulated by any other applicable code, rule, act, or ordinance. In their interpretation and application, the provisions of this ordinance shall be held to be the minimum requirements for the promotion of the public health, safety, and general welfare. This ordinance is not intended to interfere with, abrogate, or annul any other ordinances, rule or regulation, statute, or other provision of law except that, where any provision of this ordinance imposes restrictions different from those imposed by any other ordinance, rule or regulation, or other provision of law, the more restrictive provisions or higher standards shall control. § 25-29.2—Definitions: For this ordinance, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this Chapter
