Note: This certification is only required for projects that involve construction of residual management units at ultimate residuals management sites. For this certification, provide the name of the facility/site/project and the district sludge management lead planning agency. In addition, the authorized representative for the agency must provide the necessary certifying information. This information includes their signature, date of signature, printed name, and position. This section must also include the resolution number and date authorizing the representative(s) to certify for the agency. The resolution must be submitted with this form. WQM003-T D. CERTIFICATION BY THE WASTEWATER TREATMENT FACILITY OWNER Notes: This certification is required for applications that include a sewer connection/extension. This certification must be completed by the owner of the wastewater treatment facility receiving the wastewater identified in this application. Name of Facility/Site/Project: Certifying Statement: “I hereby certify that the committed flow to the below identified wastewater treatment plant does not exceed the presently permitted design capacity and, with the additional flow proposed by this application, the permitted design capacity is not anticipated to be exceeded. For the purposes of this certification, committed flow means the sum of the (1) actual metered flow, (2) flow from DEP approved TWA applications (not yet operational), and (3) flow from locally approved projects that do not require DEP approval. 241-25 October 28, 2025 RESOLUTION WHEREAS, in late August 2025, a hole was noticed in the road at Northfield Avenue (County Route 508) near a sanitary sewer manhole; and WHEREAS, the County of Essex investigated the hole and notified the West Orange Department of Public Works that there was an offset at the 8-inch sanitary sewer main; and WHEREAS, a CCTV inspection was conducted by a Township’s vendor and confirmed that section(s) of the pipe were offset allowing sewage to flow into the ground potentially causing the hole in the road; and WHEREAS, the Department of Engineering proceeded to contact the Shauger Group to conduct the repair of the 8-inch sanitary sewer main on an emergency basis; and WHEREAS, pursuant to the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11.6a the Municipal Engineer on September 19, 2025 notified the Purchasing Agent of the need to perform an emergency contract for this work with a cost between $90,000.00 $260,000.00; and WHEREAS, it was concluded that to expedite the work and to perform the emergency repair of the 8-inch sanitary sewer main at Northfield Avenue between Valley Road and Wheeler Street to protect public health and safety an emergency contract would be issued to The Shauger Group; and WHEREAS, The Shauger Group submitted an invoice dated October 15, 2025 for the emergency repair and construction of the 8-inch sanitary sewer main in the amount of $198,269.65; and WHEREAS, the Municipal Engineer by letter dated October 17, 2025 recommends paying the costs of this emergency work; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West
Orange that an emergency appropriation in an amount not to exceed $198,269.65 without authorization is authorized to The Shauger Group for emergency sanitary sewer repair and construction to the Township’s 8-inch sewer main at Northfield Avenue. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
