271-25 The Green Acres Program MEMORANDUM TO: Kelly Christopher, Project Development Specialist FROM: Dominik Hudyka, Environmental Specialist RE: Project # 0722-03-005 Rock Spring Golf Course 90 Rock Spring Rd, Block 160, Lots 2 & 10 Block 160.01, Lots 30 & 34 Block 46.01, Lot 22 West Orange Township, Essex County DATE: November 13, 2025 As requested, I have reviewed the October 2025 Phase II Environmental Site Assessment (ESA) Report prepared by Matrix New World, for the above site. The following area of concern (AOC) was investigated: AOC-11: Historic Fill Soil borings were installed in accordance with NJDEP’s April 29, 2013 Historic Fill Material Technical Guidance (Version 2), and no historic fill material was identified. The proposal to retain an LSRP and issue an Unrestricted Use Response Action Outcome (AOC) is acceptable to the Green Acres Program. Once issued, the RAO may be submitted to the Green Acres Program for review. Per the Green Acres rules, N.J.A.C. 7:36-8.2, the above-referenced AOCs must be addressed to the Department of Environmental Protection’s satisfaction before the Green Acres Program will disburse any funding for the project site. Since the Green Acres Program is not an approving authority for the investigation of sites, this memo shall not be construed as a No Further Action Letter or an approval by the Department of Environmental Protection for any action taken to address any AOC. 272-25 November 24, 2025 RESOLUTION WHEREAS, N.J.S.A. 2B:25-4(e) provides that a municipality can utilize multiple municipal prosecutors as necessary to administer justice in a timely and effective manner; and WHEREAS, N.J.S.A. 2B:25-4(g) authorizes a municipal attorney to prosecute county or municipal ordinance violations; and WHEREAS, the Township of West Orange (the “Township”) has retained the services of the law firm, Semeraro & Fahrney, LLC, to serve as the Township Attorney which services include, but are not limited to, prosecuting property maintenance, zoning, health, and other violations of the Township’s Municipal Code ; and WHEREAS, the Township seeks to affirm the authorization for the Township Attorney and his colleagues to prosecute such property maintenance, zoning, health, and other violations under the Township’s Municipal Code. NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Township hereby affirms its authorization of the Township Attorney and attorneys from the Township Attorney’s office, including, but not limited to: (i) Mark J. Semeraro, Esq.; (ii) R. Scott Fahrney, Esq.; (iii) Sean M. Kiley, Esq.; (iv) Rafiq E. Moorman, Esq.; (v) Stephen G. Piccininni, Esq.; and (vi) Megyn H. McMurtire, Esq., to prosecute such property maintenance, zoning, health, and other violations under the Township’s Municipal Code; and it is further RESOLVED the Township Attorney’s prosecution of property maintenance, zoning, health, and other violations under the Township’s Municipal Code shall be included as the services within the Township Attorney’s appointment and contract with the Township. AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE'S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL. 2942-25 BE IT ORDAINED by the Township Council of the Township of West Orange as follows: SECTION 1. All terms and conditions included in any authorized collective bargaining agreements and/or employment contracts or other agreements impacting employment terms and conditions are hereby included in SECTION 1 above. SECTION 3. All part time employee hourly rates are determined by dividing the Minimum and Maximum rates by the # of annual hours a full time employee would work for that position using the salaries identified in Section 1 above. SECTION 4. Part time employees have no annual increment for their hourly rate in Section 1 above. SECTION 5. This ordinance and the titles and salary ranges herein provided shall become effective on the dates specified and as indicated above in SECTION 1. Effective as of the date of adoption of this salary ordinance, the Mayor, or his/her designee, is hereby authorized to enter into acknowledgement agreements with employees identifying, specifying and memorializing the limitations of both pre and post-retirement benefits provided by the Township. Specifically included, but not limited to, is the provision of fully paid post-employment family health benefits to employees upon retirement that shall be strictly limited to employees hired prior to January 1, 2021. This section shall not impact employees covered under a separate Collective Bargaining Agreement. As part of entering into such acknowledgement agreements, a master list of all active employees, retiree or their surviving spouses eligible to receive limited post-employment health benefits shall be maintained. SECTION 7. In order to maintain a competitive workforce and provide social equity in the workplace, the Council endorses the Administration's intention to award step credits to new and existing non-uniformed employees for recognized or previously unrecognized educational accomplishments, bi-lingual capabilities, state certifications, promotions, performance, work experience, and other criteria established by the Administration including social equity credits for an employee's household dependent minors, as an example. SECTION 8. All ordinances and parts of ordinances heretofore enacted which are inconsistent with any provision of this ordinance are, to the extent of such inconsistency, hereby repealed. SECTION 9.
