2. The Township Attorneys are hereby directed to file the Township's Fourth Round Housing Element and Fair Share Plan, this resolution and all relevant supporting documentation and exhibits with the Superior Court of New Jersey and to take all steps necessary to proceed with a court supervised affordable housing compliance process. 3. Should any challenge to the Township's Fourth Round Housing Element and Fair Share Plan be filed, the Township Municipal Attorney and Municipal Planner are hereby directed to defend the Township against such challenge(s) and take all necessary steps in furtherance thereof. 5. A certified copy of this resolution and the Township 's Fourth Round Housing Element and Fair Share Plan shall remain on file with the Township Clerk's Office for the purpose of public inspection, and shall be uploaded to the Township's website by the Township's Municipal Clerk. 6. The Township further reserves the right to amend the Fourth Round Housing Element and Fair Share Plan, should such further amendments be required or necessary. 7. RESOLUTION OF THE PLANNING BOARD OF THE TOWNSHIP OF WEST ORANGE ADOPTING A FOURTH ROUND HOUSING ELEMENT AND FAIR SHARE PLAN WHEREAS, on March 20, 2024, Governor Murphy signed into law P.L. 2024, c.2, which amended the 1985 New Jersey Fair Housing Act (hereinafter the “Amended FHA”); and WHEREAS, the Township adopted a “binding resolution” on January 28, 2025, accepting the DCA Fourth Round Present Need Obligation of 409 and Prospective Need of 660; and WHEREAS, in accordance with the Amended FHA and Administrative Office of the Court’s Directive No. 14-24, the Township filed a timely Fourth Round Declaratory Judgment complaint (“DJ Complaint”) with the Affordable Housing Dispute Resolution Program (“the Program”), along with its binding resolution on January 31, 2025; and WHEREAS, the filing of the DJ Complaint gave the Township automatic immunity from all exclusionary zoning lawsuits, including builder’s remedy lawsuits; and WHEREAS, the Township did not receive any objections to its Present and Prospective Need Obligations by February 28, 2025 resulting in the statutory automatic acceptance of the Township’s Fourth Round obligations on March 1, 2028; and WHEREAS, on March 24, 2025, the Court entered an order establishing the Township’s Fourth Round Present Need Obligation of 409 affordable units for the Fourth Round Housing Cycle and 660 Prospective Need Obligation for the Fourth Round Housing Cycle; and

WHEREAS, upon notice duly provided pursuant to N.J.S.A. 40:55D-13, the Planning Board held a public hearing on the Fourth Round Housing Element and Fair Share Plan on September 10, 2025, and November 10, 2025; and WHEREAS, the Planning Board determined that the attached Fourth Round Housing Element and Fair Share Plan is consistent with the goals and objectives of the Township’s current Master Plan, and that the adoption and implementation of the Fourth Round Housing Element and Fair Share Plan is in the public interest and protects the public health and safety and promotes the general welfare, NOW, THEREFORE, BE IT RESOLVED, by the Planning Board of the Township of West Orange, County of Essex, State of New Jersey, that the Planning Board hereby adopts the Fourth Round Housing Element and Fair Share Plan attached hereto as Exhibit A. 58-26 February 10, 2026 RESOLUTION WHEREAS, on January 17th and 18th, 2026, two long duration snow and ice storms were predicted to begin in the early hours; and WHEREAS, the Public Works Department along with our contractors were ask to report to work at 1:00 am, January 17th, 2026 and 5 am January 18th 2026; and WHEREAS, the storm consisted of approximately 2-4 inches of snow for each day with over ten hours on January 17th and over sixteen hours on January 18th; and WHEREAS, the temperatures were below freezing from the evening of January 17th forward; and WHEREAS, to keep the roads safe for motorist, the road crews worked diligently for over 24 hours, which out of necessity depleted our road salt supplies; and WHEREAS, pursuant to the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11.6a the Acting Public Works Director on January 19th, 2026, was provided a quote to purchase salt from an alternate supplier, American Asphalt & Trucking at a cost of $121.50 per ton for a total cost of $61,543.40 as another snow event was predicted and as temperatures stay below freezing areas need to be treated with salt; and WHEREAS, the Acting Public Works Director by letter dated January 20, 2026, recommends paying the costs of this emergency purchase; and WHEREAS, the Department of Public Works did place orders for salt delivery through the state contract vendor on January 18, 2026, but it was not delivered; and WHEREAS, on or about January 23, 2026 NJ State Governor issued a state of emergency due to the impending snow storm starting January 24, 2026 with an additional snow accumulation of 9-13 inches; and

WHEREAS, the Governor of NJ ordered the state contract vendor to stop private work of salt deliveries and gave township’s “front of line privileges” to pick up salt orders placed; and WHEREAS, the Department of Public Works authorized American Asphalt and Trucking to pick up the salt ordered placed with the state contract vendor at a cost of $20.00 per ton at a total cost of $29, 578.20; and WHEREAS, sufficient funds exist for this work; and WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that an emergency appropriation in an amount not to exceed $91,121.60 is authorized to American Asphalt and Trucking for emergency purchase and delivery of 2000+ tons of road salt. BE IT FURTHER RESOLVED that this work was performed pursuant to the provisions of the Local Public Contracts Law, Emergency Contracts, N.J.S.A. 40A:11-6 as the work was required to protect public health and welfare.
