2976-26 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTIONS 7-20 STOP INTERSECTIONS OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient administration of government services; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, pursuant to N.J.S.A. 39:4-8 and -197 the Township may regulate, by Ordinance and without the approval of the Commissioner of Transportation, the passage or stopping of traffic at certain congested street corners or other designated points, consistent with the current standards prescribed by the Manual on Uniform Traffic Control Devices for Streets and Highways; and WHEREAS, the Township finds that it is necessary and proper for the preservation of the public health, safety, and welfare of the municipality and its inhabitants to erect stop signs at certain roadway intersections; and WHEREAS, the Township desires to amend Chapter 7, “Traffic,” Section 20, “Stop Intersections” of the Township Municipal Code to erect a stop sign on Renna Plaza, West Orange, New Jersey at the intersection of White Street and Ashland Avenue/Renna Plaza; and BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey as follows: Section 1. Subsection 7-20, Stop Intersections, of the Revised General Ordinances of the Township of West Orange is hereby supplemented and amended as follows pursuant to the provisions of N.J.S.A. 39: 4-8. The Municipal Engineer of the Township of West Orange designated Bright View Engineering (BVE) of Roseland. N.J. to collect data and assess conditions at the
listed location. Their methodology conforms with provisions set forth in N.J.S.A. 39:4-8 and the applicable requirements of the Manual on Uniform Traffic Control Devices (MUTCD). Section 3. If any provisions of the Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any of the provisions or applications of this Ordinance that can be given effect without the valid provision(s) or application and to this end, the provisions of the Ordinance are severable. Section 4. All other Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed. Section 5. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of any provision of this Ordinance or any supplement thereto shall be liable to the penalty of not more than fifty dollars ($50.00) or imprisonment for a term not to exceed fifteen (15) days or both, as per W.O.R.G.O. 2976-26 Legislative History The Ordinance, which amends the Traffic Regulations of the Township, designates a new Stop intersection with Stop sign on the named approach. Based on recommendations from the Stop Control Analysis conducted at White Street & Ashland Avenue/Renna Plaza and residents’ requests, the Municipal Engineer designated Bright View Engineering of Roseland to conduct the necessary traffic study and assemble data to comply with N.J.S.A. 39:4-8 regulations.
2977-26 AN ORDINANCE ADOPTING REDEVELOPMENT PLAN FOR 80 MAIN STREET WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., provides a mechanism to empower and assist local governments in efforts to promote programs of redevelopment; and WHEREAS, on December 14, 2021, the Township of West Orange (the "Township") declared the entirety of the Municipality as an Area in Need of Rehabilitation in 2021 (Resolution No. 323-21); and WHEREAS, the Township determined to explore whether the real property located at 80 Main Street, West Orange, New Jersey, more commonly known as Block 88, Lot 17 on the Township of West Orange Tax Map, (the "Property") may be an appropriate for a redevelopment plan pursuant to N.J.S.A. 40A:12A-7(f); and; WHEREAS, pursuant to N.J.S.A. 40A:12A-7(f), the Township commenced the process to prepare a redevelopment plan for the Property, after reviewing and considering a package of materials and a proposed concept provided by the Property's owner to add ground floor retail uses at the Property, setting forth potential permitted uses, rules and standards that the Township deems proper and appropriate be set forth in a redevelopment plan; and WHEREAS, on March 10, 2026, the Township Council adopted a resolution authorizing Heyer, Gruel & Associates (“HGA”), to review and evaluate the proposal and supporting materials from the Property owner and, if consistent with sound planning principles and the Township’s goals and objectives, to prepare a redevelopment plan for the Property; and #12487894.1 #12488429.1 #96041312.1
WHEREAS, HGA prepared the 80 Main Street Redevelopment Plan, dated , 2026 (the “Redevelopment Plan”), attached hereto as Exhibit A; WHEREAS, pursuant to N.J.S.A. 40A:12A-7, prior to adoption of an ordinance adopting a Redevelopment Plan, the governing body must refer the redevelopment plan to the Planning Board for review and recommendations; and WHEREAS, upon introduction of this Ordinance, the Redevelopment Plan shall be referred to the Planning Board for review and recommendations, including a determination as to the consistency of the Redevelopment Plan with the Township Master Plan and identification of any provisions of the Redevelopment Plan that it deems to be inconsistent with the Master Plan; and WHEREAS, the Township Council shall not adopt this Ordinance until it has received comments and/or recommendations from the Planning Board or until forty-five (45) days have lapsed since the introduction of this Ordinance referring the Redevelopment Plan to the Planning Board, whichever occurs first; and WHEREAS, prior to second reading and final adoption of this Ordinance, the Township Council will have reviewed and considered the Redevelopment Plan and have considered the comments and/or recommendations of the Planning Board, including its determination as to whether the Redevelopment Plan is substantially consistent with the Township Master Plan; and WHEREAS, in the event that the Planning Board finds that the Redevelopment Plan is substantially consistent with the Master Plan and has no other comments or recommendations to the Redevelopment Plan, the Council accept the Planning Board’s determinations and will proceed to adopt the Redevelopment Plan Ordinance on second reading; and #12487894.1 #12488429.1 #96041312.1
