terms, or provisions shall not be affected thereby and said illegal, unenforceable or invalid part, term, or provision shall be deemed not to be a part of this Agreement. 10. HEYS ATTESTS. Heys represents and warrants that he has carefully read each and every provision of this Agreement and that he fully understands all of the terms and conditions contained in each provision of this Agreement. Heys represents and warrants that he enters into this Agreement voluntarily, of his own free will, without any pressure or coercion from any person or entity including, but not limited to, the Township or the Releasees. 11. FULL KNOWLEDGE OF TERMS AND REVIEW PERIOD. The Township advises Heys to consult with an attorney of his choice and his expense prior to 3

executing this Agreement and Heys hereby represents and warrants that, prior to executing this Agreement, he has fully discussed its meaning and effect with an attorney of his choosing, or that he has waived his right to consult with an attorney, and he fully understands its meaning and effect. Heys has twenty-one (21) days from the date it is provided to him to consider it before signing it. In particular, Heys represents and warrants that his attorney has explained to him, and/or he fully comprehends the meaning of each of the provisions of this Agreement and that he has entered into this Agreement voluntarily. Heys’s signature also acknowledges that (1) the Township advised him to consult with an attorney before signing this Agreement; (2) he has up to twenty-one (21) days from the date he receives this Agreement to consider it before signing it; and (3) if Heys signs this Agreement less than twenty-one (21) days after receiving it, he does so knowingly and voluntarily, and waives any right he might have under the Age Discrimination in Employment Act, as amended, to the full twenty-one (21) days to consider this Agreement. Heys has seven (7) days after signing this Agreement in which to revoke his acceptance by delivering written notice revoking his acceptance. This revocation must be provided directly to the Township’s Labor Counsel, Ramon E. Rivera, Esq. of Antonelli Kantor Rivera PC, 354 Eisenhower Pkwy, Suite 1000, Livingston, New Jersey 07039. Accordingly, this Agreement shall not become effective or enforceable until the seven (7) day revocation period has expired. If Heys does not revoke this Agreement during the seven (7) day revocation period, it shall be deemed accepted. Heys agrees that he made an informed and voluntary decision to sign this Agreement on the date he has done so, because he did not need any additional time to decide whether to sign this Agreement. 2978-26 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, “TRAFFIC,” SECTION 32.2, “RESTRICTED PARKING ZONES,” OF THE MUNICIPAL CODE OF THE TOWNSHIP OF WEST ORANGE WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient administration of government services; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, N.J.S.A. 39:4-197.7. authorizes the restricted parking zones for use by residents with disabilities; and WHEREAS, the Township desires to amend Chapter 7, “Traffic,” Section 32.2, “Restricted Parking Zones,” of the Township Municipal Code to add additional restricted zones for use by residents with disabilities and removing restricted zones no longer needed; and NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Township Council of the Township of West Orange, in the County of Essex, State of New Jersey, being the governing body thereof, that Section 32.2, “Restricted Parking Zones,” of Chapter 7 “Traffic,” shall be amended as follows. Section 1. RECITALS. The foregoing whereas clauses are incorporated herein by reference and made a part hereof. Section 2. 2978-26 LEGISLATIVE HISTORY This Ordinance amends and supplements Chapter 7 Traffic, Subsection 32.2 Restricted Parking Zones of the Revised General Ordinances. Restricted Parking Stalls will be established in front of 30 Kingsley Street and 99 High Street for the exclusive use of the residents who are in possession of a NJMVC Disability ID and Parking Placard. These Stalls were requested by the residents of each location and are permissible under NJ Statutes Annotated (N.J.S.A.) 39:4- 197.7. Parking is permitted in the restricted parking zone except when prohibited by other sections of Chapter 7 of the Revised General Ordinances.

2975-26 AN ORDINANCE AMENDING CHAPTER 2, “ADMINISTRATION,”, SECTION 40.2 “JUDGE OF THE MUNICIPAL COURT; POWERS AND,” OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE TO CONSOLIDATE THE JUDGE OF THE MUNICIPAL COURT POSITIONS WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”), have an interest in the efficient operation and effective administration of government services; and WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this State or Federal Government, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, N.J.S.A. 2B:12-1, et seq., Section 2-40.1 of the Revised General Ordinances of the Township of West Orange (the “Township Code”) establishes the Municipal Court of the Township of West Orange, Essex County (the “Municipal Court”); and WHEREAS, Section 2-40.2 of the Township Code currently mandates the appointment of two Judges of the Municipal Court; and WHEREAS, the Township finds that it is in the best interest of the municipality and its inhabitants, and for the efficient operation and effective administration of services of the Municipal Court to consolidate the two judge positions into one Chief Judge position for all municipal court proceedings; and WHEREAS, the Township desires to amend Chapter 2, “Administration,” Section 40.2, “Judge of the Municipal Court; Powers and Duties” of the Township Code to consolidate the positions of Judge of the Municipal Court NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Township Council of the Township of West Orange, in the County of Essex, State of New Jersey, being the governing body thereof, that Section 40.2, “Judge of the Municipal Court; Powers and Duties,” of Chapter 2, “Administration,” shall be amended as follows. Section 2. Chapter 2, “Administration,” Section 40.2, “Judge of the Municipal Court; Powers and Duties,” shall be amended as follows: Note: Additions are indicated in bold and underline; deletions are delineated via strikethrough § 2-40.2 Judge of the Municipal Court; Powers and Duties There shall be one two Chief Judges of the Municipal Court appointed by the Mayor with the advice and consent of the Township Council. The Chief Judges of the Municipal Court shall serve for a term of three years from the date of appointment and until a successor or successors shall be appointed and qualified. The Chief Judges of the Municipal Court shall receive such compensation as provided by ordinance by the Council. The Chief Judges of the Municipal Court shall have and possess the qualifications, and shall have, possess and exercise all the functions, duties, powers, and jurisdiction conferred by N.J.S.A. 2B:12-1, et seq., as amended and supplemented by general law or ordinance. The Mayor may designate one of such Municipal Judges as "Chief Judge." The Chief Judge of the Municipal Court shall assume the prime administrative authority for the operation preside over all court proceedings of the Municipal Court in accordance with the rules governing the Courts of the State of New Jersey. The Mayor may appoint an Acting Municipal Court Judge with the advice and consent of the Township Council, pursuant to Statute, and subject to the rules governing the Courts of the State of New Jersey, in the event of disqualification, incapacity, incompetency, or death of one or both of the permanent, part-time Chief Judges referred to in this subsection. Deleted: Municipal Section 3. If any provision of this Ordinance or application thereof, under any circumstances, is held invalid, the invalidity shall not affect any other provisions or applications of this Ordinance that can be given effect without the invalid provision(s) or application(s) and to this end the provisions of this Ordinance are severable.
