the Contractor shall be responsible to pay for any additional uniformed police traffic control directors needed beyond the contract time. The cost for this item if needed, will be paid directly by the Contractor. It is the requirement of the Contractor to contact the police department to obtain the costs prior to commencing work beyond the stipulated time of completion. It is the Contractor’s sole responsibility to make payments to Extra Duty Solutions on time. Contractor is herein advised that proof of paid invoices are to be submitted for reimbursement at the time of payment(s) request. The Contractor is responsible for coordinating all work with the Township Police Department. During non-working hours, trenches shall not be left open and contractor's equipment shall not be parked in the roadway, driveways or the sidewalk area or any other area which will obstruct vehicular or pedestrian traffic. At all times the Contractor shall maintain access to all businesses and residences within the project limits. The Contractor shall coordinate with the property owners and/or tenants to ensure vehicles are not stranded in driveways or parking lots while aprons are being poured and curing. 13

While Uniformed Officers are not anticipated, the Contractor is still responsible to coordinate all work with the West Orange Police Department. 159.03.08 Traffic Direction B. Police. THIS SECTION IS DELETED AND REPLACED WITH THE FOLLOWING: When local ordinance requires or as included in the plans, the pay item TRAFFIC DIRECTOR, POLICE shall be utilized indicating the use of local uniformed police officers. An allowance has been provided for in the contract proposal for the estimated hours that Police Traffic Directors will be required during this project. The use of Police Traffic Directors will be discussed at the pre- construction meeting with the RE, Contractor, and local Traffic Safety Officer present. The Contractor will take the lead in scheduling police traffic directors with the approval of the RE. The Contractor will submit invoices to the RE for approval and then payment against the TRAFFIC DIRECTOR, POLICE allowance. Itis the responsibility of the Contractor to notify the RE and police at least 24 hours in advance (or as required by the local Police Department) of cancelations or changes to work affecting the use of TRAFFIC DIRECTOR, POLICE. Improper notice will result in any expenses related to TRAFFIC DIRECTOR, POLICE to be subtracted from the Contractors invoices. 459.04 MEASUREMENT AND PAYMENT THIS SUBSECTION IS CHANGED TO: The Township will measure and make payment for Items as follows: Item Pay Unit BREAKAWAY BARRICADE UNIT DRUM UNIT TRAFFIC CONE UNIT CONSTRUCTION SIGNS SQUARE FOOT TRAFFIC DIRECTOR, POLICE DOLLAR There will be no separate measurement or payment for relocating traffic control devices as required or as directed. THE FOLLOWING IS ADDED: The Contractor will be reimbursed for the direct cost billed by the Police Department with no additional payments for overhead or profit. The Contractor shall provide invoices from the Police Department to the RE for reimbursement. An estimated amount to cover these reimbursements has been included in the proposal. It is the intent of the project that any improvements that disturb pedestrian traffic areas will be reconstructed immediately upon disturbance/demolition to minimize any disturbance to pedestrian sidewalks, access and crosswalks. Should any prolonged disturbance or delays be encountered during construction the contractor shall install Temporary Sidewalk as required or

Should any prolonged disturbance or delays be encountered during construction the contractor shall install Temporary Sidewalk as required or as directed by the engineer in areas of high pedestrian traffic. No separate or individual payment shall be made for Temporary Sidewalk. SECTION 160 — PRICE ADJUSTMENTS 160,.03.01 Fuel Price Adjustment THE FOLLOWING IS ADDED BEFORE THE FIRST PARAGRAPH: Fuel Price Adjustment will be reimbursable when deemed eligible by NJSA 40A:11-13. 14

THE FIFTH PARAGRAPH IS CHANGED TO: The Department will calculate fuel price adjustment on a monthly basis using the following formula: F = (MF -BF)xG Where: F = Fuel Price Adjustment MF = = Monthly Fuel Price Index for work performed from the first day of the month to the last day of the month for the month prior to the estimate cutoff date BF= Basic Fuel Price Index G= Gallons of Fuel for Price Adjustment THE SEVENTH PARAGRAPH IS CHANGED TO: The basic fuel price index is the previous month's fuel price index before receipt of bids. The Department will use the fuel price index for the month before the regular monthly estimate cutoff date as the Monthly Fuel Price Index for work performed in the previous calendar month. If the Monthly Fuel Price Index increases by 50 percent or more over the Basic Fuel Price Index do not perform any work involving Items listed in Table 160.03.01-1 without written approval from the RE. 160.03.02 Asphalt Price Adjustment THE FOLLOWING IS ADDED BEFORE THE FIRST PARAGRAPH: Asphalt Price Adjustment will be reimbursable when deemed eligible by NJSA 40A:11-13). THE THIRD PARAGRAPH IS CHANGED TO: The Department will calculate the asphalt price adjustment by the following formula: A= (MA- BA) xT = Asphalt Price Adjustment MA= Monthly Asphalt Price Index for work performed from the first day of the month to the last day of the month for the month prior to the estimate cutoff date BA= Basic Asphalt Price Index = Tons of New Asphalt Binder? The Department will determine the weight of asphalt binder for price adjustment by multiplying the percentage of new asphalt binder in the approved job mix formula by the weight of the item containing asphalt binder. Ifa Hot Mix Asphalt Item has a payment unit other than ton, the Department will apply an appropriate conversion factor to determine the number of tons of asphalt binder used. Tons of New Asphalt Binder shall be the tons of Asphalt Cement generated from Virgin Asphalt Cement only THE SIXTH PARAGRAPH IS CHANGED TO: The basic asphalt price index is the asphalt price index for the month before the opening of bids. The Department will use the asphalt price index for the month before the regular monthly estimate cutoff date as the monthly asphalt price index for work performed in the previous calendar month. The fuel requirement for items not determined to be eligible and for pay items calling for less than 500 gallons of fuel, shall not be eligible for a fuel price adjustment. If more than one pay item has the same nomenclature but with different thicknesses, depths, or types, each individual pay item must require 500 gallons or more of fuel to be eligible for a fuel price adjustment. If more than one pay item has the exact same nomenclature, similar pay items shall be combined and this combination must require 500 gallons or more of fuel to be eligible for the fuel price adjustment. Fuel price adjustments shall not be made in those months for which the monthly fuel price index has changed by less than five percent from the basic fuel price. All invoices for payment shall be accompanied by the calculation of any fuel price adjustment. 160.04 MEASUREMENT AND PAYMENT THIS SUBSECTION IS CHANGED TO: The Township will measure and make payment for Items as follows: Item Pay Unit FUEL PRICE ADJUSTMENT DOLLAR ASPHALT PRICE ADJUSTMENT DOLLAR The Contract quantity of FUEL PRICE ADJUSTMENT and ASPHALT PRICE ADJUSTMENT is a dollar allowance and the engineer has inserted a bid price in the Schedule of Prices. The Township will base payment for FUEL PRICE ADJUSTMENT and ASPHALT PRICE ADJUSTMENT on the actual cost as evidenced by calculations. 16

DIVISION 200 —- EARTHWORK SECTION 201 — CLEARING SITE 201.01 DESCRIPTION THE FOLLOWING IS ADDED: Clearing Site shall also include the removal and/or resetting/relocation of all signs, the repair of any damaged sprinklers, concrete sign posts, fences and all existing features/obstructions, either standing or felled within the limits of construction of the project, as shown on the plans or as directed by the engineer, for which no specific pay item is provided for in the contract. Work also includes removal of pavement reflectors and castings. All trees less than 6” in diameter as measured at 4’ from grade will be removed under this item. Tree trimming of all trees as directed by the Township will be included under this item. In the performance of the work under this item, the Contractor will be held responsible for any damage to existing construction that is to remain in place. The Contractor shall use extreme care and exercise every precaution necessary to prevent damage or injury thereto. Any damage as a result of the Contractor's operations shall be repaired or replaced by him to the satisfaction of the Engineer at no additional expense to the Township. The contractor shall be responsible for coordination with the West Orange Township Police Department for traffic operations and parking prohibitions during construction. The Police Department shalll be notified 72 hours in advance when requesting an officer for traffic contrl. The contractor is responsible to schedule uniformed Police Traffic Directors using the Department's third party scheduling service, Extra Duty Solutions. Contractor must retain a Certified Tree Expert for tree evaluation where necessary. No additional payment will be made for Tree Expert; price to be included in the clearing site. All trees that have roots that encroach into the proposed curbs or pavement and are to be saved shall be evealuated by the contractor's Certified Tree Expert. All evaluations shall be in writing and shall accurately identify tree in question by station and offset. Ail evaluations shall be submitted to the Professional Engineer for review and consultation with the Township Forester prior to cutting any roots. No separate payment will be made for this work, but the cost shall be included in the clearing site item. In areas where the roots encroach into the curb line, the full pavement section shall be

THE FOLLOWING IS ADDED: Clearing Site shall also include the removal of sidewalks, curbs, etc. in the area of the scheduled items of work. Clearing Site shall also include the removal of all obstructions of trees, shrubs, bushes, weeds, roots and similar vegetative materials either standing or felled (unless otherwise noted or directed by the Engineer) with the construction limits for which payment is not otherwise provided in the Contract but which is directed for removal on the plans or by the Engineer during construction. Clearing Site shall also include the removal and disposal of existing signs. The Contractor shall check to see if the Borough wants to keep the signs prior to disposal. Clearing Site shall also include removal and disposal of structures or other obstructions above existing ground level either standing or felled which are designated for removal on the plans or directed by the Engineer during construction and for which payment is not otherwise provided in the Contract. Clearing Site shall also include sawcutting, removal and disposal of all bituminous and concrete materials, whether specified or unspecified on the plans, required for the completion of the work and for which payment is not otherwise provided in the Contract. Clearing Site shall also include removal, temporary storage or resetting if required, and final resetting of mail boxes, signs, pole borders, timber ties, fences, guard rails, bus shelters, hedges, trees or shrubs whether specified or unspecified on the plans or as directed by the Engineer. 201.04 MEASUREMENT AND PAYMENT THIS SUBSECTION IS CHANGED TO: The Township will measure and make payment for Items as follows: Item Pay Unit CLEARING SITE LUMP SUM RESET MONITORING WELL WITH CONCRETE ENCASING AROUND THE WELL BY LICENSED NJDEP DRILLER (iF AND WHERE DIRECTED) UNIT THE FOLLOWING IS ADDED: CLEARING SITE to be paid as follows: + 25% Paid upon completion of all drainage improvements or a reduced percentage as determined by the engineer should all drainage improvements not be completed at the time of an intermediate payment. + 25% Paid Upon completion of concrete curb/sidewalk/driveway improvements or a reduced percentage as determined by the engineer should all concrete curb/sidewalk/driveway not be completed at the time of an intermediate payment. * 25% Paid upon completicn of all Hot Mix Asphalt Items or a reduced percentage as determined by the engineer should all Hot Mix Asphalt Items not be completed at the time of an intermediate payment. * 25% shall be retained and paid upon final payment. SECTION 202 — EXCAVATION 202.01 DESCRIPTION THE FOLLOWING IS ADDED: The excavations shall be made to conform with the lines of the finished structures wherever practical. The excavations shall not be carried below the required grades by machine and back-filled to the grade of foundations, bottom slabs, footings, or pipelines. The trench in which pipe, manholes, or inlets are to be constructed shall be excavated from the surface and to such depths and widths (not less than 12 inches greater than the

footings, or pipelines. The trench in which pipe, manholes, or inlets are to be constructed shall be excavated from the surface and to such depths and widths (not less than 12 inches greater than the maximum external dimension of the structure) as will give suitable room for bracing and supporting, pumping and draining, and for removing from the excavation any material which the Engineer may deem inadequate for foundation. All excavations shall be of sufficient width to permit work to be done completely, in the manner intended and of the size specified and/or shown on the plans. 18
