1 Public Meeting – October 2, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 7, 2011. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Reports), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. John Schmidt, 27 Glen, Llewellyn Park, West Orange Rosary Morelli, 22 Ralph Road, West Orange Joseph Sorbino, 18 Sheridan Avenue, West Orange Mark Meyerowitz, 19 Howell Drive, West Orange John Blanton, Forest Hill Road, West Orange Anthony Pugliese, Public Information Officer for Essex County There was no one else who wished to be heard and the public hearing was closed.
2 Minutes The Public Minutes of July 17, 2012, August 21, 2012 and September 11, 2012 were approved as submitted. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. *It is noted that Councilman Krakoviak abstained from voting on the above. Resolutions The following resolutions were adopted: Resolution #178-12 Resolution Amending the Agreement Between the Township of West Orange and Paul Grygiel for Services Rendered (Resolution 153-11) in the Amount NTE $270.00 Resolution #180-12 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Resolution #181-12 Resolution Authorizing Raffle Licenses Resolution #182-12 Resolution Authorizing Change Order No. 1 & Final which Represents as-built Quantities Resulting in a Decrease of $3,168.01 with Granada Construction Corp. for the 2011 Roadway Improvements, Phase I, Various Streets Resolution #183-12 Resolution Authorizing a Subordination of Mortgage/Yolette Adolphe, 29 Joyce Street Resolution #184-12 Resolution Authorizing an Abandoned Car Sale to be Held on October 16, 2012 by Twin Towing Inc., Select Towing Inc. & Panek’s Service Center, Inc. Resolution #185-12 Resolution Authorizing Change Order No. 2 & Final which Represents a Decrease of $18,771.40 with Shauger Property Services to the Valley Road Streetscape
3 Resolution #186-12 Resolution Authorizing the Tax Collector to Refund Overpayment of 2012 Real Estate Taxes Due to Overpayment by Property Owner Resolution #187-12 Resolution in Support of the Planning Board’s Opposition to New Jersey Senate Bill S1534 and Assembly Bill A2586 Urging the State Legislation to Vote Against the Passage of Both Bills Resolution #188-12 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Ordinance on Second and Final Reading Ordinance 2361-12 On motion made by Councilwoman Spango and seconded by Councilman Guarino, AN ORDINANCE CREATING NEW TOWNSHIP CODE SECTION 14, SECTION 8.2A AND REVISING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE TO ALLOW FOR SNOW, IDE AND GRASS REMOVAL ON PRIVATELY OWNED PROPERTIES BY TOWNSHIP EMPLOYEES OR AGENTS, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. 4 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, AN ORDINANCE CREATING RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE MUNICIPAL EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEES STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL, was taken up on first reading by title only. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on October 16, 2012. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #177-12 Resolution Authorizing a License Agreement Between the Township of West Orange and New Jersey Arts Incubator (NJAI) for the Use of Oskar Schindler Performing Arts Center (OSPAC) for a Term of Five (5) Years Following discussion and on motion made by Councilman Cirilo and seconded by Councilman Guarino, the above mentioned resolution was tabled. All members voting “Aye” to table. Resolution #179-12 Resolution Authorizing an Executive Session for the Purpose of Discussing Litigation Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #189-12 Resolution Authorizing a Collective Bargaining Agreement with AFSCME Council 52 Local 3476 (Non- Supervisory Union”) Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was adopted.

Resolution #190-12 Resolution Authorizing a One Year Extension to Reliable Wood to Operate the West Orange Recycling Center Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
