Public Meeting – December 4, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 17, 2011. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 7 (Report of Township Officers), Item 8 (Bills) and Item 9 (Certain Resolutions). Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Reports The Municipal Judge’s Report for the Month of October, 2012 was received and placed on file. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolution #227-12 Resolution Authorizing the Settlement of Tax Appeals on Behalf of Blackburn Development Company, Block 164, Lot 1.01 in Accordance with “Schedule A” Resolution #228-12 Resolution Authorizing the Settlement of Tax Appeals on Behalf of West Orange Plaza, property located at the intersection of Eagle Rock Avenue and Prospect Avenue under Docket Nos. 001069-2010 and 001219-2012 for years 2010, 2011 and 2012 in accordance with “Schedule A” Resolution #229-12 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Essex County Board of Taxation Ordinances on Second and Final Reading – None Ordinances on First Reading- Ordinance #2365-12 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE- HANDICAPPED PARKING - 112 WHITTLESEY AVENUE, was introduced and approved on first reading. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned ordinance was approved on first reading, ordered advertised according to law, to come up for second and final reading on December 18, 2012. All members voting “Aye”. Ordinance #2366-12 BOND ORDINANCE REAPPROPRIATING $1,606,799.25 PROCEEDS OF OBLIGATION NOT NEEDED FOR THEIR ORIGINAL PURPOSE FOR THE ACQUISTION OF VARIOUS IMPROVEMENTS BY THE TOWNSHIP OF WEST ORANGE, NJ, was introduced and approved on first reading. All members voting “Aye”. 3
The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was approved on first reading ordered advertised according to law, to come up for second and final reading on December 18, 2012. All members voting “Aye”. Ordinance #2367-12 BOND ORDINANCE AMENDING VARIOUS BOND ORDINANCE TO AMEND THE DESCRIPTION TO PROVIDE FOR VARIOUS CAPITAL IMPROVEMENTS FOR AND BY THE TOWNSHIP OF WEST ORANGE IN THE COUNTY OF ESSEX, NEW JERSEY, was introduced and approved on first reading. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was approved on first reading, ordered advertised according to law, to come up for second and final reading on December 18, 2012. All members voting “Aye”. Resolution #230-12 Resolution Authorizing an Executive Session On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the Council adjourned to the Alcoholic Beverage Control Board. All members voting “Aye”. ABC HEARING Resolution #493-12 Person to Person Transfer to a Pocket License – Lincoln Highway Industrial Development, LLC Appropriate fees have been paid and Affidavit of Publication on file. 4
Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #494-12 Person to Person Transfer and Place to Place Transfer, West Orange News, Inc. t/a Pleasant Valley Food & Spirits Appropriate fees have been paid and Affidavit of Publication on file. Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the Council adjourned as the Alcoholic Beverage Control Board. All members voting “Aye”. On motion made by Councilwoman Spango and seconded by Councilman Guarino, the meeting was adjourned at 10:37 P.M.
