1 Public Meeting – December 18, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 17, 2011. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Report), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. 4 RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF CIVIL SERVICE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2365-12 On motion made by Councilwoman Spango and seconded by Councilman Guarino, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, HANDICAPPED PARKING, 112 WHITTLESEY AVENUE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Ordinance #2366-12 On motion made by Councilman Guarino and seconded by Councilwoman Spango, BOND ORDINANCE REAPPROPRIATING $1,606,799.25 PROCEEDS OF OBLIGATION NOT NEEDED FOR THEIR ORIGINAL
5 PURPOSE FOR THE ACQUISITION OF VARIOUS IMPROVEMENTS BY THE TOWNSHIP OF WEST ORANGE, NJ, was taken up on second and final reading. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Ordinance #2367-12 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, BOND ORDINANCE AMENDING VARIOUS BOND ORDINANCES TO AMEND THE DESCRIPTION TO PROVIDE FOR VARIOUS CAPITAL IMPROVEMENTS FOR AND BY THE TOWNSHIP OF WEST ORANGE IN THE COUNTY OF ESSEX, NEW JERSEY, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”.
6 Ordinances on First Reading - None Resolution #231-12 Special Improvement District 2013 Budget (Public Hearing and Adoption) Municipal Clerk Karen J. Carnevale stated that this is the scheduled time for the public hearing on the 2013Special Improvement District Budget which was introduced on November 27, 2012 and advertised in full on November 29, 2012 as required by law, together with a notice of hearing for this time. All members voting “Aye”. Council President Cirilo stated that printed copies of the Budget have been made available to the public during the past week and a supply is here for anyone desiring a copy. “Anyone who has not secured a copy of the budget may now do so. Before opening the hearing, I will outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Would anyone like to be heard?” There was no one who wished to be heard at this time. On motion made by Councilwoman Spango and seconded by Councilman Guarino, the public hearing on the budget was closed. All members voting “Aye”. On motion made by Councilman Guarino and seconded by Councilwoman Spango, the Special Improvement District Budget for the Year 2013 was adopted. All members voting “Aye”. Resolution #232-12 Resolution Authorizing the Essex County Community Development Block Grant Program 2013 (CDBG) Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned resolution, as amended, was adopted. Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Guarino recused himself from the above resolution.
7 Resolution #236-12 Resolution Authorizing the Mayor to Execute the Essex County Division of Senior Services Contract Update for Visiting Nurse Services in the Amount of $17,171 for the Period of January 1, 2013 – December 31, 2013 and to Execute the New Three Year Contract for the Period of January 1, 2013 through December 31, 2013 in the Amount of $17,171 and January 1, 2014 through December 31, 2014 in the Amount of $17,171 and January 1, 2015 through December 31, 2015 in the Amount of $17,171 Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the meeting was recessed until the January 8, 2013 meeting. All members voting “Aye”. KAREN J.
