1 Public Meeting – March 5, 2013 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 7 (Report), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time: Rosary Morelli, 22 Ralph Road, West Orange Robert Kinzel, Kinzel Lane, West Orange Mark Meyerowitz, 19 Howell Drive, West Orange Anthony Pugliese, Public Information Officer for Essex County Christine Bosco, 4 Masson Place, West Orange There was no one else who wished to be heard and the public hearing was closed. Report The Downtown West Orange Alliance SID Assessment List was received and placed on file. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached.

2 Resolutions The following resolutions were adopted: Resolution #36-13 Resolution Authorizing Raffle Licenses Resolution #37-13 REMOVED Resolution #39-13 Resolution Authorizing the Appropriation Transfer Pursuant to NJSA 40A:4-58 Resolution #40-13 Resolution Authorizing the Payment of an Additional $500 to Pat Dwyer, Planning Board Attorney for his work on the Generator Standard Project Resolution #41-13 Resolution Authorizing the Re-Appointment Jessica Glicker as the Township’s Communications Director/Public Information Officer for a Fee of $3,166 Per Month for an Additional One Year Term Commencing on January 1, 2013 until December 31, 2013. Resolution #42-13 Resolution Authorizing the Appointment of Alicia Skinner t/a Skinner Consulting Services as the Township’s Grant Writer for a Fee of $2,333.33 Per Month for a Period of One Year Commencing on March 1, 2013 until February 28, 2014 Resolution #43-13 Resolution Awarding a Contract for Additional Professional Land Surveying Services to G.C. Stewart Associates, 320 Runnymeade Road, Essex Fells, NJ for a Fee NTE $2,000 for Wiley Terrace and NTE $850 for Nestro Road Resolution #44-13 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey – 26 Rock Spring Road

3 Resolution #45-13 Resolution Authorizing the Township to Sell at Public Auction Unclaimed Vehicles Pursuant to State and Local Laws Resolution #46-13 Resolution for Professional Services Through a Fair and Open Process Resolution #47-13 Resolution Authorizing the Tax Collector and Treasurer of the Township of West Orange to Refund the Overpayment of Taxes to the City of Orange in the Amount of $4,115.89 Resolution #48-13 Resolution Authorizing the Tax Collector and Treasurer of the Township of West Orange to Refund a Duplicate Payment of Taxes, First Quarter 2013- 32 Nestro Road Resolution #50-13 Resolution Authorizing the Purchase of Firefighter Clothing from a State Contract Vendor, Turnout Fire & Safety, Inc., 3468 Kennedy Blvd., Jersey City, NJ 07307 in the Amount of $44,284.89 Resolution #51-13 Resolution Authorizing the Township of West Orange to Apply for the 2012 Recycling Tonnage Grant Ordinance on Second and Final Reading Ordinance #2369-13 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ESTABLISHING FEES AND RATES AT GINNY DUENKEL POOL FOR THE 2013 SEASON, was taken up on second and final reading. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only.

4 The Council President asked if there was anyone who wished to be heard. Christine Bosco, 4 Masson Place, West Orange commented on the above ordinance. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango, and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinances on First Reading Ordinance #2370-13 AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE MUNICIPAL EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF CIVIL SERVICE – COAH COORDINATOR, MUNICIPAL ALLIANCE COORDINATOR, was introduced and passed on first reading. The Clerk read the ordinance by title only. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on March 19, 2013. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinance #2371-13 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 19, SECTION 10 OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED “ANNUAL SEWER CHARGES”, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. Following discussion and on motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on March 19, 2013.

Resolution #38-13 Resolution Awarding a Contract to D’Onofrio & Son, Inc., Landscaping, 47 Van Ness Terrace, Maplewood, NJ 07040 in the Amount of $135,000 for the Maintenance of Various Township Owned Parcels, Including Turf Maintenance, Litter and Debris Collection, Weed Control and Fall Leaf Collection and Disposal Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #49-13 Resolution Authorizing an Executive Session to Discuss a Matter of Litigation – Occidental/Passaic River, (Personnel) On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was amended. All members voting “Aye” to amend. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the meeting was adjourned at 10:00 P.M. All members voting “Aye”. KAREN J.
