1 Public Meeting – May 21, 2013 The Township Council of the Township of West Orange met in the Council Chambers , 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 29, 2012. Roll Call: Present: Councilman Guarino, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo Absent: None *It is noted that Councilman Guarino arrived at 7:04 P.M. The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 8 (Bills) and Item 9 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Guarino, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Rosary Morelli, 22 Ralph Road, West Orange Robert Dryer, Kinzel Lane, West Orange Paula Dickson-Taylor, Watchung Avenue, West Orange Christine Bosco, 4 Masson Place, West Orange There was no one else who wished to be heard and the public hearing was closed.

2 Minutes The public minutes of May 7, 2013 were approved as submitted. Bills The Bill List was received and ordered paid. A Summary of the Bill List is attached. Resolutions The following resolutions were adopted: Resolution #101-13 Resolution Authorizing Issuance of Raffle Licenses Resolution #102-13 Resolution Authorizing an Agreement Between the Township of West Orange and the Borough of North Caldwell for Animal Control Services in Which West Orange will be paid a Sum of $3,150.00 Per Annum for Services Provided for the Contract Year 2013 Resolution #104-13 Resolution Authorizing Fireworks Display – West Orange Recreation Department Resolution #105-13 Resolution Authorizing Fireworks Display – Montclair Golf Club Resolution #106-13 Resolution Authorizing Fireworks Display – Rock Spring Club Resolution #107-13 Resolution Authorizing Fireworks Display – Essex County Country Club Resolution #109-13 Resolution Authorizing a Refund of Duplicate Payment of Second Quarter Taxes to Listed Taxpayers Resolution #110-13 Resolution Authorizing the Sale of Abandoned Cars

3 Ordinances on Second and Final Reading Ordinance #2375-13 On motion made by Councilwoman McCartney and seconded by Councilman Guarino, BOND ORDINANCE AUTHORIZING THE DEVELOPMENT OF A PARK AT RIDGEWAY AVENUE IN ANF OR THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, NEW JERSEY, APPROPRIATING $500,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $475,000 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF, was taken up on second and final reading. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. The Council President stated that this is the scheduled time for public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Clare Silvestri, 20 Grand View Avenue, West Orange commented on the above ordinance. Mayor Robert Parisi commented on the above ordinance. Christine Bosco, 4 Masson Place, West Orange commented on the above ordinance. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinance #2376-13 On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, AN ORDINANCE AUTHORIZING SPECIAL EMERGENCY APPROPRIATION PURSUANT TO N.J.S.A. 40A:4-53 FOR SEVERANCE LIABILITIES RESULTING FROM ACCRUED LEAVE IN CONNECTION WITH THE LAYOFF OR RETIREMENT OF EMPLOYEES, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only.

4 The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance on First Reading Ordinance #2377-13 BOND ORDINANCE AMENDING BOND ORDINANCE 2366-12 FINALLY ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY ON DECEMBER 18, 2012, was introduced and passed on first reading. The Clerk read the ordinance by title only. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on June 11, 2013. Councilman Guarino, Councilwoman McCartney, Councilwoman Spango and Council President Cirilo voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #100-13 Resolution for the Authorization for Sale of Notes Special Emergency Appropriation Severance Liabilities Resulting from Accrued Leave in Connection with the Layoff or Retirement of Employees John O. Gross, Chief Financial Officer, commented on the above resolution and responded to questions from Council. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #103-13 Resolution Authorizing Entry of a Right of Way Agreement between the Township and the Bel Air Condominium Association Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted.

5 All members voting “Aye”. Resolution #108-13 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #111-13 Resolution Awarding a Professional Services Contract to the Firm Appraisal Systems, Inc., 110 South Jefferson Road, Whippany, New Jersey to Provide Tax Appeals Services on Behalf of the Township in an Amount NTE $60,000 Kevin Dillon, Tax Assessor, commented on the above resolution and responded to questions from Council. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #112-13 Resolution Amending Resolution 7-13 Emergency Temporary Appropriation for the Purpose of Funding Eminent Tax Appeals Prior to Adoption of 2013 Budget – N.J.S.A. 40A:4-20 Following discussion and on motion made by Councilwoman Spango and seconded by Councilman Krakoviak, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the meeting was adjourned at 9:29 P.M.
